3 | 22, by changing "January" to "March"; and | ||||||
4 | by replacing lines 31 through 34 on page 21, all of page 22, | ||||||
5 | and lines 1 through 29 on page 23 with the following:

6 | "Section 95. The County Jail Act is amended by adding | ||||||
7 | Section 17.10 as follows: | ||||||
8 | (730 ILCS 125/17.10 new) | ||||||
9 | Sec. 17.10. Requirements in connection with HIV/AIDS. | ||||||
10 | (a) In each county other than Cook, during the medical | ||||||
11 | admissions exam, the warden of the jail, a correctional officer | ||||||
12 | at the jail, or a member of the jail medical staff must provide | ||||||
13 | the prisoner with appropriate written information concerning | ||||||
14 | human immunodeficiency virus (HIV) and acquired | ||||||
15 | immunodeficiency syndrome (AIDS). The Department of Public | ||||||
16 | Health and community-based organizations certified to provide | ||||||
17 | HIV/AIDS testing must provide these informational materials to | ||||||
18 | the warden at no cost to the county. The warden, a correctional | ||||||
19 | officer, or a member of the jail medical staff must inform the | ||||||
20 | prisoner of the option of being tested for infection with HIV | ||||||
21 | by a certified local community-based agency or other available | ||||||
22 | medical provider at no charge to the prisoner. | ||||||
23 | (b) In Cook County, during the medical admissions exam, an |

1 | employee of the Cook County Bureau of Health Services must | ||||||
2 | provide the prisoner with appropriate written information | ||||||
3 | concerning human immunodeficiency virus (HIV) and acquired | ||||||
4 | immunodeficiency syndrome (AIDS) and must also provide the | ||||||
5 | prisoner with option of testing for infection with HIV or any | ||||||
6 | other identified causative agent of AIDS, as well as counseling | ||||||
7 | in connection with such testing. The Department of Public | ||||||
8 | Health and community-based organizations certified to provide | ||||||
9 | HIV/AIDS testing must provide these informational materials to | ||||||
10 | the Bureau at no cost to the county. The
testing provided under | ||||||
11 | this subsection (b) shall be conducted by the Cook County | ||||||
12 | Bureau of Health Services and shall consist of an enzyme-linked
| ||||||
13 | immunosorbent assay (ELISA) test or any other test approved by
| ||||||
14 | the Department of Public Health. If the test result is | ||||||
15 | positive,
the Western Blot Assay or more reliable confirmatory | ||||||
16 | test shall be
administered. | ||||||
17 | (c) In each county, the warden of the jail must make | ||||||
18 | appropriate written information concerning HIV/AIDS available | ||||||
19 | to every visitor to the jail. This information must include | ||||||
20 | information concerning persons or entities to contact for local | ||||||
21 | counseling and testing. The Department of Public Health and | ||||||
22 | community-based organizations certified to provide HIV/AIDS | ||||||
23 | testing must provide these informational materials to the | ||||||
24 | warden at no cost to the office of the county sheriff. | ||||||
25 | (d) Implementation of this Section is subject to | ||||||
26 | appropriation. ".
