| AMENDMENT TO HOUSE BILL 3031

| AMENDMENT NO. ______. Amend Amend House Bill 3031 by |

| replacing the title with the following:

| "AN ACT concerning health."; and
|
| 5 |
| by replacing everything after the enacting clause with the |
| 6 |
| following:
|
| 7 |
| "Section 5. The Children's Mental Health Act of 2003 is |
| 8 |
| amended by adding Section 20 as follows:
|

| (405 ILCS 49/20 new) |
| 10 |
| Sec. 20. Mandatory screening and testing prohibited. |
| 11 |
| Nothing contained in this Act shall be construed to authorize |
| 12 |
| or require mandatory mental health screenings or testing of a |
| 13 |
| pregnant woman or a child against the wishes of the pregnant |
| 14 |
| woman or of the child's parent or legal guardian. Mental health |
| 15 |
| screening or testing of a child may not be authorized or |
| 16 |
| required without the written permission of the child's parent |
| 17 |
| or legal guardian. |
| 18 |
| Nothing contained in this amendatory Act of the 94th |
| 19 |
| General Assembly shall be construed to supersede the intent of |
| 20 |
| Section 3-501 of the Mental Health and Developmental |
| 21 |
| Disabilities Code.

| Section 99. Effective date. This Act takes effect upon |
