SYNOPSIS AS INTRODUCED:

320 ILCS 65/32 new

    Amends the Illinois Public Aid Code and the Family Caregiver Act. Provides that a family caregiver who provides in-home care to an older adult who is a frail individual and who claims that frail individual as a dependent for federal and State income tax purposes is eligible for cash assistance based on the frail individual's needs, not to exceed $2,000 per month. Requires the Department of Public Aid to apply for a waiver of federal law and regulations to allow the use of Medicaid funds to fund this cash assistance program, and requires the Department on Aging to cooperate with the Department of Public Aid to secure Medicaid funding. Effective immediately.

1     AN ACT concerning aging.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5.25 as follows:
 
6     (305 ILCS 5/5-5.25 new)
7     Sec. 5-5.25. Family caregivers. The Department of Public
8 Aid, in collaboration with the Department on Aging, shall apply
9 for any waiver of federal law and regulations necessary to
10 allow the use of Medicaid funds to fully or partially fund the
11 program of cash assistance for family caregivers authorized
12 under Section 32 of the Family Caregiver Act. Upon approval of
13 all such necessary waivers, the Department of Public Aid shall
14 cooperate with the Department on Aging to ensure that the
15 family caregiver cash assistance program is funded with
16 Medicaid funds to the maximum extent allowable.
 
17     Section 10. The Family Caregiver Act is amended by adding
18 Section 32 as follows:
 
19     (320 ILCS 65/32 new)
20     Sec. 32. Cash assistance. A family caregiver who provides
21 in-home care to an older adult who is a frail individual and
22 who claims that frail individual as a dependent for federal and
23 State income tax purposes is eligible for cash assistance based
24 on the frail individual's needs, not to exceed $2,000 per
25 month. The Department shall adopt rules prescribing the form
26 and manner of application for cash assistance under this
27 Section and prescribing guidelines for awarding such cash
28 assistance. The Department shall cooperate with the Department
29 of Public Aid to secure Medicaid funding of the cash assistance
30 program.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.
