Amends the Illinois Highway Code. Provides that the Department of Transportation, in reviewing for approval any ordinance or resolution passed or adopted by any municipality for expenditure of motor fuel tax funds for construction, a highway program, or a contract, shall rely on the audit conducted by the municipality to determine whether the proposed expenditure of those motor fuel tax funds is for an authorized purpose.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Highway Code is amended by adding |
5 |
| Section 7-203.5 as follows: |

| (605 ILCS 5/7-203.5 new) |

| Sec. 7-203.5. Department approval of motor fuel tax fund |
8 |
| expenditures. The Department, in reviewing for approval any |
9 |
| ordinance or resolution passed or adopted by any municipality |
10 |
| under Section 7-203 or 7-203.1 for expenditure of motor fuel |
11 |
| tax funds for construction, a highway program, or a contract, |
12 |
| shall rely on the audit conducted by the municipality to |
13 |
| determine whether the proposed expenditure of those motor fuel |
14 |
| tax funds is for one or more of the purposes stated in Sections |
15 |
| 7-202.1 through 7-202.22.
