Amends the Brominated Fire Retardant Prevention Act. Prohibits the manufacturing, processing, and distribution into commerce of a product or flame-retarded part of a product containing more than one-tenth of 1% of decabromodiphenyl ether (decaBDE) by mass after January 1, 2008. Permits the processing of recycled material containing decaBDE.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Brominated Fire Retardant Prevention Act is |
| 5 |
| amended by changing Section 15 as follows: |
| 6 |
| (410 ILCS 48/15)
|
| 7 |
| Sec. 15. Regulation of brominated flame retardant. |
| 8 |
| (a) Effective January 1, 2006, a person may not |
| 9 |
| manufacture, process, or distribute in commerce a product or a |
| 10 |
| flame-retarded part of a product containing more than one-tenth |
| 11 |
| of 1% of pentaBDE or octaBDE. Effective January 1, 2008, a |
| 12 |
| person may not manufacture, process, or distribute in commerce |
| 13 |
| a product or a flame-retarded part of a product containing more |
| 14 |
| than one-tenth of 1% of decaBDE by mass. |
| 15 |
| (b) Subsection (a) of this Section does not apply to the |
| 16 |
| following:
|
| 17 |
| (1) The sale by a business, charity, or private party |
| 18 |
| of any used product containing PBDE. |
| 19 |
| (2) The distribution in commerce of original equipment |
| 20 |
| manufacturer replacement service parts manufactured prior |
| 21 |
| to the effective date of this Act. |
| 22 |
| (3) The processing of recycled material containing |
| 23 |
| decaBDE, pentaBDE, or octaBDE in compliance with |
| 24 |
| applicable State and federal laws.
