| AMENDMENT NO. ______. Amend Senate Bill 46 on page 2, line |

| 17, by replacing "A" with "Except as otherwise provided in |

| subsection (e), a"; and

| on page 2, immediately below line 22, by inserting the |
| 6 |
| following: |

| "(e) This Section does not apply in a home rule |
| 8 |
| municipality that, on or before January 1, 2005, has passed an |
| 9 |
| ordinance regulating building access from stairwell enclosures |
| 10 |
| in buildings that are more than 4 stories in height.".
