    AN ACT concerning public aid.

    Be it enacted by the People of the State of Illinois, 
3
represented in the General Assembly:

    Section 5. The Illinois Public Aid Code is amended by 
5
changing Section 5-2.1a as follows:

    (305 ILCS 5/5-2.1a)

    Sec. 5-2.1a. Treatment of trust amounts. To the
the extent 
8
required by
federal
law, the Illinois Department shall provide 
9
by rule for the consideration of
trusts and similar legal 
10
instruments or devices established by a person in the
Illinois 
11
Department's determination of the person's eligibility for and 
12
the
amount of assistance provided under this Article.
This 
13
Section shall be enforced by the Department of Human Services, 
14
acting as
successor to the Department of Public Aid under the 
15
Department of Human
Services Act.
