| AMENDMENT NO. ______. Amend Senate Bill 431 as follows:

| on page 10, by replacing line 34 with the following: |

| "July 1, 2008, no person who has not owned or operated a clean |

| construction or demolition debris fill operation within 6 |
| 6 |
| months prior to this effective date shall use clean |

| construction or"; and

| on page 11, line 2, by replacing "they have" with "that person |
| 9 |
| has".
