| AMENDMENT TO SENATE BILL 431

| AMENDMENT NO. ______. Amend Senate Bill 431 as follows:

| on page 25, line 36, by deleting "or approving any interim"; |
| 4 |
| and
|
| 5 |
| on page 26 by replacing lines 1 through 13 with the following: |

| "for a clean construction or demolition debris fill operation |
| 7 |
| in which any ownership interest is transferred, the Agency |
| 8 |
| shall conduct an evaluation of the operation if there is |
| 9 |
| substantial evidence that any previous activities at the site |
| 10 |
| or facility caused or allowed contamination of the site. The |
| 11 |
| Agency may deny a permit if previous activities at the site are |
| 12 |
| shown to have caused or allowed contamination at the site as |
| 13 |
| determined by a court of law, unless such contamination is |
| 14 |
| authorized under any".
