| AMENDMENT NO. ______. Amend Senate Bill 854 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The School Code is amended by adding Section |
| 5 |
| 27A-12.5 as follows: |
| 6 |
| (105 ILCS 5/27A-12.5 new) |
| 7 |
| Sec. 27A-12.5. Union contract school. |
| 8 |
| (a) The local school board of a school district located in |
| 9 |
| a city having a population exceeding 500,000 may enter into an |
| 10 |
| agreement with a provider to establish and operate a union |
| 11 |
| contract school in the district. No more than 5 union contract |
| 12 |
| schools may operate at any one time in the district. The union |
| 13 |
| contract school shall have all of the powers and duties that a |
| 14 |
| charter school has under this Article, except as otherwise |
| 15 |
| provided under this Section. |
| 16 |
| (b) A union contract school established under this Section |
| 17 |
| is subject to the following requirements: |
| 18 |
| (1) All teachers of the union contract school must |
| 19 |
| belong to a collective bargaining unit. |
| 20 |
| (2) The school must be in an area of the district that |
| 21 |
| the local school board has designated as over-crowded. |
| 22 |
| (3) The school must have local attendance boundaries. |
| 23 |
| (4) Curriculum and staffing must be determined in an |
| 24 |
| agreement between the local school board, the provider, and |
