AMENDMENT TO SENATE BILL 854

AMENDMENT NO. ______. Amend Senate Bill 854 by replacing everything after the enacting clause with the following:

"Section 5. The School Code is amended by adding Section 27A-12.5 as follows:

(105 ILCS 5/27A-12.5 new)

Sec. 27A-12.5. Union contract school.

(a) The local school board of a school district located in a city having a population exceeding 500,000 may enter into an agreement with a provider to establish and operate a union contract school in the district. No more than 5 union contract schools may operate at any one time in the district. The union contract school shall have all of the powers and duties that a charter school has under this Article, except as otherwise provided under this Section.

(b) A union contract school established under this Section is subject to the following requirements:

(1) All teachers of the union contract school must belong to a collective bargaining unit.

(2) The school must be in an area of the district that the local school board has designated as over-crowded.

(3) The school must have local attendance boundaries.

(4) Curriculum and staffing must be determined in an agreement between the local school board, the provider, and the teachers' collective bargaining unit.

(c) Under the agreement to establish and operate a union contract school, the provider must enter into a 5-year contract with the teachers' collective bargaining unit that sets forth what provisions of the district's collective bargaining agreement will be waived by the teachers of the union contract school. This contract must be entered into before the union contract school begins operation.

Section 99. Effective date. This Act takes effect upon becoming law.".
