| AN ACT concerning finance.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Tobacco Product Manufacturers' Escrow Act is |
| 5 |
| amended by changing Section 20 as follows:
|
| 6 |
| (30 ILCS 168/20)
|
| 7 |
| Sec. 20. If this amendatory Act of the 93rd General |
| 8 |
| Assembly or any
portion of the amendment to
subdivision |
| 9 |
| (2)(B)(ii) of subsection (a) of Section 15 made by this |
| 10 |
| amendatory
Act of the
93rd General Assembly is held by a court |
| 11 |
| of competent jurisdiction to be
unconstitutional, then such |
| 12 |
| subdivision (2)(B)(ii) of subsection (a) of Section
15 shall be
|
| 13 |
| deemed to be repealed in its entirety. If subdivision (2)(B)
|
| 14 |
| (2)(B)(ii) of
subsection (a) of Section 15 shall thereafter be |
| 15 |
| held by a court of competent
jurisdiction to be
|
| 16 |
| unconstitutional, then this amendatory Act of the 93rd General |
| 17 |
| Assembly shall
be deemed repealed and subdivision (2)(B)(ii) of |
| 18 |
| subsection (a) of Section 15
shall be
restored as if no such |
| 19 |
| amendments had been made. Neither any holding of
|
| 20 |
| unconstitutionality nor the
repeal of subdivision
(2)(B)(ii) |
| 21 |
| of subsection (a) of Section 15 shall affect,
impair, or
|
| 22 |
| invalidate any other portion of Section 15 or the application |
| 23 |
| of such Section
to any other
person or circumstance, and such |
| 24 |
| remaining portions of Section 15 shall at all
times continue in |
| 25 |
| full force and effect.

| Section 99. Effective date. This Act takes effect upon |
| 28 |
| becoming law.
