AMENDMENT TO SENATE BILL 1909

    AMENDMENT NO. ______. Amend Senate Bill 1909 as follows:

on page 2, by replacing line 17 with the following:

"in items (a)(3)(A) and (a) (7) through (9) shall be"; and

on page 2, by replacing lines 22 through 26 with the following:
6
    "for metals when tested utilizing test method ASTM 
7
    D3987-85. The sample or samples tested shall be"; and
 
8
on page 2, by replacing line 29 with the following:
9
    "purposes described in items (a)(3)(A) and (a)(7) through 
10
    (9)"; and
 
11
on page 2, by replacing line 36 with the following:

    "(a)(5) and (a)(6) of this Section, or as required"; and
 
13
on page 4, by replacing line 3 with the following:

"uses set forth in items (a)(3)(A) and (a)(7) through (9) of 
15
this"; and

on page 4, immediately after line 29, by inserting the 
17
following:

    "Notwithstanding the other provisions of this subsection 
19
(b), written beneficial use determination applications for the 
20
use of CCB at sites governed by the federal Surface Mining

Control and Reclamation Act of 1977 (P.L. 95-87) or the rules

and regulations thereunder, or by any law or rule or regulation

adopted by the State of Illinois pursuant thereto, shall be

reviewed and approved by the Office of Mines and Minerals 
5
within the Department of Natural Resources pursuant to 62 Ill. 
6
Adm. Code §§ 1700-1850. Further, appeals of those 
7
determinations shall be made pursuant to the Illinois 
8
Administrative Review Law.".
