| AMENDMENT TO SENATE BILL 2394

| AMENDMENT NO. ______. Amend Senate Bill 2394, AS AMENDED, |

| by replacing everything after the enacting clause with the |
| 4 |
| following:
|

| "Section 5. The Illinois Public Aid Code is amended by |
| 6 |
| adding Section 5-5e as follows:
|
| 7 |
| (305 ILCS 5/5-5e new) |
| 8 |
| Sec. 5-5e. Home and Community Based Services Waivers; |
| 9 |
| "developmental disability". All Home and Community Based |
| 10 |
| Services Waivers for persons with Developmental Disabilities |
| 11 |
| must consider a person with autism spectrum disorder as a |
| 12 |
| "person with a related condition" in determining eligibility |
| 13 |
| for services under the waiver so long as the person otherwise |
| 14 |
| meets State and federal eligibility requirements for the |
| 15 |
| waiver. A person with autism spectrum disorder who has a |
| 16 |
| developmental disability shall be included in the |
| 17 |
| cross-disability database compiled and maintained by the |
| 18 |
| Department of Human Services pursuant to Section 10-26 of the |
| 19 |
| Department of Human Services Act.

| 20 |
| Section 99. Effective date. This Act takes effect upon |
| 21 |
| becoming law.".
