| AN ACT concerning safety.
|
| 2 |
| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Spent Nuclear Fuel Act is amended by |
| 5 |
| changing Section 2 as follows:
|
| 6 |
| (420 ILCS 15/2) (from Ch. 111 1/2, par. 230.22)
|
| 7 |
| Sec. 2. No person may dispose of, store, or accept any |
| 8 |
| spent nuclear
fuel which was used in any power generating |
| 9 |
| facility located outside this
State, or transport into this |
| 10 |
| State for disposal or storage any spent nuclear
fuel which was |
| 11 |
| used in any power generating facility located outside this
|
| 12 |
| State, unless the state of origin of such spent nuclear fuel |
| 13 |
| has a facility,
which is not part of a power generating |
| 14 |
| facility, for the disposal or storage
of spent nuclear fuel |
| 15 |
| substantially like that of this State and has entered
into a |
| 16 |
| reciprocity agreement with this State. The determination as to |
| 17 |
| whether
the state of origin has a disposal or storage facility |
| 18 |
| for spent nuclear
fuel substantially like that of this State is |
| 19 |
| to be made by the Director
of the Illinois Emergency Management |
| 20 |
| Agency
Department of Nuclear Safety and
all reciprocity |
| 21 |
| agreements must be approved by a majority of the members
of |
| 22 |
| both Houses of the General Assembly and approved and signed by |
| 23 |
| the Governor.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.
