| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Facility Planning Area Rules Act is amended |
| 5 |
| by changing Section 10 as follows:
|

|

| (Section scheduled to be repealed on January 1, 2007.)

| Sec. 10. Rules. Within one year of the

| this Act, the
Illinois
Environmental Protection Agency shall |

| propose rules related to facilities
planning that take into |
| 11 |
| account the findings and recommendations of (1) its
Facility
|
| 12 |
| Planning Area Stakeholder Group and (2) studies of the |
| 13 |
| facilities planning area
program, including those findings and |
| 14 |
| recommendations related to: nonpoint
source pollution |
| 15 |
| management, construction site runoff, urban runoff,
|
| 16 |
| consistency with antidegradation regulations, alternatives |
| 17 |
| analysis,
interagency coordination, alternative dispute |
| 18 |
| resolution, and consistency with
local, county, and regional |
| 19 |
| land use plans and resource
protection plans. |
