| AMENDMENT TO SENATE BILL 2845

| AMENDMENT NO. ______. Amend Senate Bill 2845 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Environmental Protection Act is amended by |
| 5 |
| adding Section 9.14 as follows:
|

| Sec. 9.14. Ban on waste burning or incineration at |
| 8 |
| hospitals and related sites or facilities.
|
| 9 |
| (a) Except as provided in subsection (b), on and after July |
| 10 |
| 1, 2007, no person shall burn or incinerate at the following |
| 11 |
| locations any waste generated at any hospital: |
| 12 |
| (1) any hospital; |
| 13 |
| (2) any site or facility owned or operated by any |
| 14 |
| hospital; or |
| 15 |
| (3) any site or facility owned or operated by any owner |
| 16 |
| or operator of any hospital. |
| 17 |
| (b) A hospital may, until July 1, 2011, continue to burn or |
| 18 |
| incinerate at the hospital waste that is generated at the |
| 19 |
| hospital if, by July 1, 2007, the hospital enters into a |
| 20 |
| written agreement with the Agency to cease burning or |
| 21 |
| incinerating such waste at the hospital by July 1, 2011. In no |
| 22 |
| case shall waste generated at the hospital be burned or |
| 23 |
| incinerated at the hospital on or after July 1, 2011. |

| (c) For purposes of this Section, the term "hospital" means |
