Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that any person who drives a vehicle on the highways of this State is deemed to have given consent to having his or her saliva (as well as his or her breath, blood, or urine) tested for the presence of drugs, intoxicating compounds, or alcohol. Provides for statutory summary suspension of the person's driving privileges if he or she refuses the testing or if his or her saliva reveals an alcohol concentration of 0.08 or more or the presence of drugs or intoxicating compounds in any amount.

Deletes everything after the enacting clause. Amends the Illinois Vehicle Code. Provides that, if a law enforcement officer believes that a motor vehicle that was driven by or under the control of a person under the influence of alcohol, drugs, or intoxicating compounds has caused the death of or personal injury to another person, the person shall, at the officer's request, submit to testing of his or her saliva. Provides that a driver involved in an accident involving death or personal injury shall be deemed to have given consent to the testing. Provides that the Department of State Police shall prescribe rules providing for the testing of saliva.
