Synopsis As Introduced
Amends the State Treasurer Act. Requires the Treasurer to post information on his or her official website concerning the investment of public funds. Sets forth the required information. Does not require posting of information that is exempt from inspection and copying under the Freedom of Information Act.

Deletes everything after the enacting clause. Amends the Illinois Procurement Code. Prohibits campaign contributions from business entities with aggregate State contracts or pending State contract bids of more than $50,000, or from the affiliated entities of such business entities, to any political committees established to promote the candidacy of the executive branch constitutional officeholder responsible for awarding the contracts or a declared candidate for that office. Limits the campaign contributions from persons affiliated with those business entities to those officeholders and candidates. Specifies the duration of the prohibitions and the penalties for violations.

Senate Floor Amendment No. 4

Amends the Election Code. Requires that the business entities register with the State Board of Elections, including a disclosure of entities and persons affiliated with the business entity, and report to the State Board of Elections all contributions made to political committees subject to the Election Code. Specifies the contents of the registration statements and the contribution reports. Makes willful filing of false or incomplete registration statement a business offense subject to a specified fine. Requires that those business entities, affiliated entities, and affiliated persons give notice when making a contribution that the relevant business entity has State contracts totaling the specified amount.

Deletes everything after the enacting clause. Amends the Election Code and Illinois Procurement Code. Prohibits campaign contributions from business entities with annual aggregate State contracts or pending State contract bids of more than $50,000, or from the affiliated entities and affiliated persons of such business entities, to any political committees established to promote the candidacy of (i) the executive branch constitutional officeholder responsible for awarding the contracts or (ii) in the case of current State contracts of more than $50,000, a declared candidate for that office. Specifies the duration of the prohibitions and the penalties for violations. Requires that business entities, affiliated entities, and affiliated persons prohibited from making contributions must notify any political committee to which they make a contribution of the relevant business entity's status. Requires that those business entities electronically register with the State Board of Elections, including disclosure of their affiliated entities and affiliated persons. Specifies the contents and duration of registration and provides penalties for failure to register or maintain accurate registration. Requires that the State Board of Elections maintain the registration in a searchable database with campaign finance reports. Requires that each State contract or bid include a certification by the contractor or bidder that it is not required to register as a business entity with the State Board of Elections or it has so registered and that the contract is voidable for the business entity's failure to register or maintain accurate registration. Prohibits a chief procurement officer from accepting a bid or proposal from a business entity required to register unless a copy of the registration certificate is attached. Makes the provisions severable.

Senate Floor Amendment No. 8
Further amends the Election Code to define "State contract" and to provide that the State Board of Elections shall not place on its website the name of a minor child, but shall link to contributions made by anyone reporting from the same residential address as any affiliated person. Further amends the Illinois Procurement Code to define "contract", "State contract", and "contract with a State agency", and to create specified exceptions to the definition for cost reimbursement contracts, purchase for care agreements, and certain grants, loans, and tax credit agreements.

Senate Floor Amendment No. 9
In the Illinois Procurement Code, in the definition of an "affiliated entity", adds a political committee sponsored by a non-profit organization related to the business entity. Makes technical corrections.

Governor Amendatory Veto Message
Recommends that the Illinois Governmental Ethics Act be amended (i) to prohibit members of the General Assembly from being employed by the State, a municipality, or a unit of local government, with specified exceptions, and (ii) to require members of the General Assembly and candidates for nomination or election to the General Assembly, when filing statements of economic interests, to disclose information concerning lobbying activities and representation cases. Recommends that the Compensation Review Act be amended to require the Board to file 2 reports, one for judges and State’s Attorneys and one for all other positions, and to require the General Assembly to approve or reduce a report for it to take effect (instead of disapprove or reduct a report to prevent it from taking effect). Recommends that the Illinois Procurement Code be further amended to include the legislative branch and the Auditor General within prohibitions on political contributions from certain State contractors. Makes other changes.
