Synopsis As Introduced
Amends the Public Utilities Act. Extends to July 1, 2011 (rather than July 1, 2008) the date by which a gas utility must commence construction of a coal gasification facility in order for provisions authorizing the utility to enter into a 20-year supply contract with a company for synthetic natural gas produced from coal through the gasification process to apply. Makes changes to the method by which it is determined that the cost for synthetic natural gas under such a contract is reasonable and prudent and recoverable through the purchased gas adjustment clause. Provides that a utility shall be limited to selling 50% of its output of natural gas. Effective immediately.

House Amendment No. 1
Extends to July 1, 2015 (rather than July 1, 2008) the date by which a gas utility other than a gas utility located in Jefferson County must have received all necessary permits for the construction and operation (instead of must have commenced construction) of a coal gasification facility in order for provisions authorizing the utility to enter into a 20-year supply contract with a company for synthetic natural gas produced from coal through the gasification process to apply. Changes language to provide that price restrictions in a supply contract must be at a specified amount at the time the contract is signed (instead of at the time the contract term commences). Makes changes to the method by which it is determined that the cost for synthetic natural gas under such a contract is reasonable and prudent and recoverable through the purchased gas adjustment clause except for a gas utility located in Jefferson County. Provides that a utility other than a gas utility located in Jefferson County shall be limited to selling 50% of its output of natural gas.
