235 ILCS 5/6-9from Ch. 43, par. 126

Synopsis As Introduced
Amends the Liquor Control Act of 1934. In a Section involving trade mark registration, provides that prior to amending or withdrawing such registration, each manufacturer, non-resident dealer, distributor, importing distributor, or foreign importer who owns or controls the trade mark, brand name, or name of any alcoholic liquor shall, at least 30 days prior to the effective date of the registration amendment or withdrawal, notify each person to whom such manufacturer, non-resident dealer, distributor, importing distributor, or foreign importer previously granted the right to sell at wholesale, specifying the particular trade mark, brand, or name of alcoholic liquor as to which such right is amended or withdrawn and the geographical area or areas for which such right is amended or withdrawn to such person. At the written request of all affected parties, the 30 day notification requirement may be waived by the Liquor Control Commission. Effective immediately.

House Amendment No. 1
In a Section involving trade mark registration, provides that prior to amending or withdrawing such registration, each manufacturer, non-resident dealer, distributor, importing distributor, or foreign importer who owns or controls the trade mark, brand name, or name of any beer (instead of alcoholic liquor) shall, at least 30 days prior to the effective date of the registration amendment or withdrawal, notify each person to whom such manufacturer, non-resident dealer, distributor, importing distributor, or foreign importer previously granted the right to sell at wholesale, specifying the particular trade mark, brand, or name of beer (instead of alcoholic liquor) as to which such right is amended or withdrawn and the geographical area or areas for which such right is amended or withdrawn to such person.

Deletes reference to:

Adds reference to:

235 ILCS 5/6-2from Ch. 43, par. 120

Deletes everything after the enacting clause. Amends the Liquor Control Act of 1934. Provides that specified officials shall be the local liquor control commissioner for their respective territories as long as that official or his or her designee does not have a direct interest in the manufacture, sale, or distribution of alcoholic liquor. Provides that if the official has a direct interest in the manufacture, sale, or distribution of alcoholic liquor, the council or board over which he or she presides must appoint a liquor control commissioner other than that official. Provides that a mayor of a city or president of a village board of trustees may have a direct interest in the manufacture, sale, or distribution of alcoholic liquor as long as the council or board appoints a liquor control commissioner pursuant to the provisions concerning specified officials as local liquor control commissioners. Effective immediately.
