Amends the State Finance Act. Makes a technical change in a Section concerning the Tobacco Settlement Recovery Fund.

Senate Floor Amendment No. 2
Deletes reference to:

Deletes everything after the enacting clause. Amends the State Finance Act. Provides that, beginning July 1, 2008 and through June 30, 2009, the Governor may direct the State Comptroller and the State Treasurer to transfer moneys from certain special funds into the General Revenue Fund. The amounts transferred may be used only to pay Medicaid obligations, State financial obligations that secure federal funds, or obligations of the State Board of Education. Provides that the amendatory Act may be cited as the Federal Transfer Maximization Law of 2008. Effective immediately.

Senate Floor Amendment No. 3
Adds 3 additional funds to the list of those funds exempted from being subject to transfers to the General Revenue Fund.

 State Debt Impact Note (Government Forecasting & Accountability)
 SB 790, as engrossed, would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 Fiscal Note (Office of the Comptroller)
 Since the legislation does not specify which funds may be ultimately transferred to the General Revenue Fund, the Office is unable to determine the fiscal impact without knowing the identity of those funds. However, the Office issued the Traditional Budgetary Report (a copy is located in the House Journal Room) that lists the budgetary balances as of the end of fiscal year 2007 for all funds in the State Treasury and is enclosed for your information.

Replaces everything after the enacting clause. Amends the State Finance Act. Creates the FY09 Budget Relief Fund. Directs the Treasurer and Comptroller to transfer amounts in quarterly installments from various funds to the FY09 Budget Relief Fund. Provides that amounts may be expended from the Fund only pursuant to specific authorization by appropriation. Authorizes re-transfers to meet expenditure obligations. Amends the State Employees Group Insurance Act of 1971 to provide that no contributions are required from the FY09 Budget Relief Fund in State Fiscal Year 2009. Effective immediately.
