| 8 | on page 90, by replacing line 7 with the following: | ||||||
| 9 | "(13) This Section applies only until an organization | ||||||
| 10 | licensee for the race track affiliated with a wagering | ||||||
| 11 | facility receives its first payment from the fee imposed | ||||||
| 12 | under subsection (a) of Section 7 of the Riverboat and | ||||||
| 13 | Casino Gambling Act. | ||||||

| 8 | contrary, the Board may license minority person-owned | ||||||
| 9 | businesses or female-owned businesses to purchase a total of | ||||||
| 10 | 600 positions by a process of competitive bidding. No minority | ||||||
| 11 | person-owned business or female-owned business may purchase | ||||||
| 12 | more than 50 positions. The owners of any positions acquired | ||||||
| 13 | under this subsection (h-7) may lease these positions to an | ||||||
| 14 | owners licensee. Each minority person-owned business or | ||||||
| 15 | female-owned business that purchases a position under this | ||||||
| 16 | subsection (h-7) must pay a privilege tax of 5% annually of the | ||||||
| 17 | annual lease amount of each position it owns to the Board to be | ||||||
| 18 | deposited into the State Gaming Fund. The Board shall adopt | ||||||
| 19 | rules as necessary to implement the provisions of this | ||||||
| 20 | subsection (h-7). For the purposes of this Act, these | ||||||
| 21 | additional positions shall not count toward the total number of | ||||||
| 22 | positions an owners licensee is authorized to operate under | ||||||
| 23 | this Act. For the purposes of this subsection (h-7), the
terms | ||||||
| 24 | "minority person" and "female" have the meanings provided
in | ||||||
| |||||||
| |||||||
| 1 | Section 2 of the Business Enterprise for Minorities,
Females, | ||||||
| 2 | and Persons with Disabilities Act."; and | ||||||
| 3 | on page 191, immediately below line 9, by inserting the | ||||||
| 4 | following: | ||||||
| 5 | "(k) notwithstanding any rule or statute to the contrary, | ||||||
| 6 | any licensed owner holding 3 or more owners licenses on May 31, | ||||||
| 7 | 2007 may continue to hold those licenses, but may not hold any | ||||||
| 8 | more than the number of licenses held on that date."; and | ||||||
| 9 | on page 219, line 26, after "games", by inserting "(including | ||||||
| 10 | electronic poker and positions authorized under subsection | ||||||
| 11 | (h-7) of Section 7)"; and | ||||||
| 12 | on page 220, immediately below line 14, by inserting the | ||||||
| 13 | following: | ||||||
| 14 | "For the imposition of the privilege tax in this subsection | ||||||
| 15 | (a-4), amounts paid pursuant to subsection (a) of Section 7 | ||||||
| 16 | into the Horse Racing Equity Trust Fund shall not be included | ||||||
| 17 | in the determination of annual gross gaming receipts."; and | ||||||
| 18 | on page 220, line 17, after the period, by inserting "For the | ||||||
