AMENDMENT TO HOUSE BILL 138

    AMENDMENT NO. ______. Amend House Bill 138 on page 5, by 
3
inserting immediately below line 14 the following:
4
    "(h) All Institute information concerning medical research 
5
shall be confidential and privileged and not subject to 
6
disclosure to any person other than Institute personnel."; and

 
7
on page 6, by inserting immediately below line 7 the following:
8
    "(c) A member of a scientific peer review panel or any 
9
other advisory committee that may be established by the 
10
Department who has a conflict of interest with respect to a 
11
matter may not discuss that matter with other peer review panel 
12
or advisory committee members or with Committee members and 
13
shall not vote or otherwise participate in any peer review 
14
panel or advisory committee action with respect to that matter.  
15
Each recusal of a peer review panel or advisory committee 
16
member occurring during a peer review panel or advisory 
17
committee meeting shall be made a part of the minutes or

recording of the meeting in accordance with the Open Meetings 
2
Act."; and

on page 6, line 8, by changing "(c)" to "(d)"; and

on page 6, by replacing lines 12 through 14 with the following:

    "Section 30. Disclosure of Committee, scientific peer 
6
review panel, or advisory committee member income and 
7
interests.

    (a)  Each Committee, scientific peer review panel, and any

advisory committee member shall file with the Secretary of";

on page 7, line 5, by inserting after "member" the following:

on page 7, line 9, by inserting after "member" the following:
