    AMENDMENT NO. ______. Amend House Bill 286 by replacing

everything after the enacting clause with the following:

    "Section 5. The Illinois Municipal Code is amended  by 
5
changing Section 11-5-1.5 as follows:

    (65 ILCS 5/11-5-1.5)

    Sec. 11-5-1.5. Adult entertainment facility. It is 
8
prohibited within a municipality to locate an adult 
9
entertainment
facility within 1,000 feet of the property

10
boundaries of any school, day care center, cemetery, public 
11
park, forest
preserve, public
housing, and place of religious

12
worship.

    For the purposes of this Section, "adult entertainment 
14
facility" means
(i) a striptease club or pornographic movie 
15
theatre
whose business is the commercial
sale, dissemination,

or distribution of sexually explicit material,
shows, or other

2
exhibitions
or (ii) an adult bookstore or adult video store in 
3
which 25% or more of its stock-in-trade, books, magazines, and

films for sale, exhibition, or viewing on-premises are sexually 
5
explicit material
whose primary
business is the commercial 
6
sale, dissemination, or distribution of sexually
explicit 
7
material, shows, or other exhibitions.
