Amends the Human Skeletal Remains Protection Act to authorize the Historic Preservation Agency and Illinois State Museum to release human skeletal remains and artifacts to a unit of local government for reburial under specified conditions. Requires the unit of local government to pay for transportation and reinterment.

| AN ACT concerning State government.
|
| 2 |
| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Human Skeletal Remains Protection Act is |
| 5 |
| amended by changing Section 14 as follows:
|

| Sec. 14. All human skeletal remains and grave artifacts in
|
| 8 |
| unregistered graves are held in trust for the people of |
| 9 |
| Illinois by the
State and are under the jurisdiction of the |
| 10 |
| Historic Preservation Agency.
All materials collected under |
| 11 |
| this Act shall be maintained, with dignity
and respect, for the |
| 12 |
| people of the State under the care of the Illinois
State |
| 13 |
| Museum.
|
| 14 |
| Nothing in this Act shall prevent the Agency or the Museum |
| 15 |
| from releasing remains when petitioned to do so by a unit of |
| 16 |
| local government requesting reinterment in a cemetery located |
| 17 |
| within the unit of local government's boundaries of the remains |
| 18 |
| after the Agency or Museum has determined the remains are |
| 19 |
| non-indigenous to the place of discovery and of no intrinsic |
| 20 |
| value to warrant further study or archival preservation by |
| 21 |
| either the Agency or the Museum using the methods and |
| 22 |
| technology available at the date of the requested release. All |
| 23 |
| expenses to provide transportation and reinterment at the site |
