| AN ACT concerning local government.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Fire Protection District Act is amended by |
| 5 |
| adding Section 10c as follows:
|

| (70 ILCS 705/10c new) |
| 7 |
| Sec. 10c. Asset distribution; contracts. Upon termination |
| 8 |
| of a contract between a fire protection district and a separate |
| 9 |
| fire department entity or upon dissolution of the fire |
| 10 |
| department entity, if the fire department entity has assumed |
| 11 |
| control of assets that were paid for by the fire protection |
| 12 |
| district and if the contract does not provide for the transfer |
| 13 |
| of assets, those assets shall revert back to the fire |
| 14 |
| protection district for use in providing fire protection |
| 15 |
| services. Nothing in this Section impairs any existing contract |
| 16 |
| or prevents a fire department or fire protection district from |
| 17 |
| making other provisions for the distribution of assets in the |
| 18 |
| terms of a future contract.
