    AMENDMENT NO. ______. Amend House Bill 814  by replacing

everything after the enacting clause with the following:

    "Section 5. The Public Utilities Act is amended  by adding 
5
Section 9-247 as follows:

    (220 ILCS 5/9-247  new)
7
    Sec. 9-247. Submission of diversified power procurement 
8
pricing strategy.

    (a) An electric utility shall, prior to filing a tariff for 
10
the approval of electric rates pursuant to an auction, issue 
11
requests for proposals seeking bids:
12
        (1) to supply base load electricity for more than 3 
13
    years but no longer than 30 years;
14
        (2) to supply base load electricity for more than one 
15
    year and up to 3 years;
16
        (3) to supply peak load electricity for one year or

    less; and
2
        (4) for the supply of electricity from energy efficient 
3
    sources including, but not limited to, renewable energy 
4
    sources.

    An electric utility shall receive bids for each type of 
6
contract from at least 3 sources. These bids shall be submitted 
7
by the electric utility as part of any tariff for the approval 
8
of electric rates pursuant to an auction.

    (b) The Commission shall approve rates for electricity that 
10
are part of the diversified power procurement pricing strategy 
11
provided for in subsection (a) of this Section and that provide 
12
the lowest possible cost to consumers for each consumer class.

    Section 99. Effective date. This Act takes effect upon 
14
becoming law.".
