| AN ACT concerning public aid.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 1. Short title. This Act may be cited as the Good |
5 |
| Samaritan Computer Program Act. |
6 |
| Section 5. Definition. In this Act, "Department" means the |
7 |
| Department of Commerce and Economic Opportunity.
|

| Section 10. Good Samaritan Computer Program Trust Fund. The |
9 |
| Good Samaritan Computer Program
Trust Fund is created as a |
10 |
| special fund in the State treasury. The Department
shall |
11 |
| administer the Fund. The Department shall deposit moneys |
12 |
| received from
the following sources into the Fund:
|
13 |
| (1) Voluntary donations from individuals, foundations, |
14 |
| corporations, and
other sources.
|
15 |
| (2) Proceeds from fundraising events held for the |
16 |
| purpose of generating
moneys for the Fund. |
17 |
| Section 15. Solicitation of contributions to Fund. The |
18 |
| Department may take appropriate measures to solicit voluntary |
19 |
| contributions to the Fund from individuals, foundations, |
20 |
| corporations, and other sources. |

| Section 20. Administration of Fund. The Department shall |
2 |
| administer the Good Samaritan Computer Program Trust Fund. |
3 |
| Donations received for the Fund shall be made available for the |
4 |
| purpose of assisting low-income individuals and families in |
5 |
| purchasing computers, except
that the
Department may use up to |
6 |
| 10% of the moneys donated for the Fund for the
Department's |
7 |
| expenses incurred in administering the Fund. |
8 |
| Section 25. Distribution of moneys from Fund. Subject to |
9 |
| appropriations, the Department may
spend
moneys from the Good |
10 |
| Samaritan Computer Program Trust Fund for the purpose of |
11 |
| providing
assistance authorized under Section 20.
The |
12 |
| Department shall ensure that moneys donated for
the Fund (other |
13 |
| than
moneys used
for administrative expenses as authorized in |
14 |
| Section 20) are distributed to
low-income
individuals and |
15 |
| families who reside in the county from which those moneys were |
16 |
| received. |
17 |
| Section 30. Annual report. On or before May 31 of each |
18 |
| year, beginning in
2009, the Department shall provide an annual |
19 |
| report to the General Assembly on
the use and effectiveness of |
20 |
| the Good Samaritan Computer Program Trust Fund. The report
|
21 |
| shall include the amount of money deposited into the Fund, the |
22 |
| amount of money
allocated from the Fund for the direct benefit |
23 |
| of low-income individuals and families, the
number of |
24 |
| low-income households served by the Fund, by county, and
|

| recommendations for improving the operation and effectiveness |
2 |
| of the Fund. |

| Section 85. No rulemaking authority. Notwithstanding any |
4 |
| other rulemaking authority that may exist, neither the Governor |
5 |
| nor any agency or agency head under the jurisdiction of the |
6 |
| Governor has any authority to make or promulgate rules to |
7 |
| implement or enforce the provisions of this Act. If, however, |
8 |
| the Governor believes that rules are necessary to implement or |
9 |
| enforce the provisions of this Act, the Governor may suggest |
10 |
| rules to the General Assembly by filing them with the Clerk of |
11 |
| the House and Secretary of the Senate and by requesting that |
12 |
| the General Assembly authorize such rulemaking by law, enact |
13 |
| those suggested rules into law, or take any other appropriate |
14 |
| action in the General Assembly's discretion. Nothing contained |
15 |
| in this Act shall be interpreted to grant rulemaking authority |
16 |
| under any other Illinois statute where such authority is not |
17 |
| otherwise explicitly given. For the purposes of this Act, |
18 |
| "rules" is given the meaning contained in Section 1-70 of the |
19 |
| Illinois Administrative Procedure Act, and "agency" and |
20 |
| "agency head" are given the meanings contained in Sections 1-20 |
21 |
| and 1-25 of the Illinois Administrative Procedure Act to the |
22 |
| extent that such definitions apply to agencies or agency heads |
23 |
| under the jurisdiction of the Governor. |

| Section 90. The State Finance Act is amended by adding |
25 |
| Section 5.675 as follows: |
