Amends the Department of Public Health Powers and Duties Law. With respect to delegation of duties, changes "county and multiple county boards of health" to "local health authorities". Provides that nothing precludes a local health authority from exercising authority granted by statute or ordinance absent a delegation from the Department. Makes other changes.

| AN ACT concerning State government.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Department of Public Health Powers and |
5 |
| Duties Law of the
Civil Administrative Code of Illinois is |
6 |
| amended by changing Section 2310-15 as follows:
|

| (20 ILCS 2310/2310-15) (was 20 ILCS 2310/55.02)

| Sec. 2310-15. General supervision of health; delegation to |
9 |
| local health authorities
boards of
health . To have the general |
10 |
| supervision of the interests of the
health
and lives of the |
11 |
| people of the State and to exercise the rights, powers,
and
|
12 |
| duties of those Acts that it is by law authorized to enforce. |
13 |
| The
Department shall have the general authority to delegate to |
14 |
| local health authorities
county and
multiple-county boards of |
15 |
| health the duties under those Acts it is
authorized to enforce |
16 |
| for the purpose of local administration and
enforcement. Upon |
17 |
| accepting the delegation of duties , local health authorities
|
18 |
| county and multiple-county
boards of health shall administer |
19 |
| and enforce the minimum program standards
promulgated by the |
20 |
| Department under the provisions of those Acts. Nothing in this |
21 |
| Section precludes a local health authority from exercising the |
22 |
| authority and responsibility granted to it by statute or |
23 |
| ordinance absent a delegation from the Department. Local health |
