| 1 | AN ACT concerning State government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Military Code of Illinois is amended by | ||||||
| 5 | adding Section 31 as follows: | ||||||
| 6 | (20 ILCS 1805/31 new) | ||||||
| 7 | Sec. 31. Removal of sensitive material. No employee of the | ||||||
| 8 | Department of Military Affairs may remove electronic or paper | ||||||
| 9 | copies of sensitive material from Department offices without | ||||||
| 10 | the express authorization of the Adjutant General. For the | ||||||
| 11 | purposes of this Section, "sensitive material" means an | ||||||
| 12 | individual's first name or first initial and last name in | ||||||
| 13 | combination with any one or more of the following data | ||||||
| 14 | elements, when either the name or the data elements are not | ||||||
| 15 | encrypted or redacted: | ||||||
| 16 | (1) social security number;
| ||||||
| 17 | (2) driver's license number or State identification | ||||||
| 18 | card number;
| ||||||
| 19 | (3) account number or credit card or debit card number, | ||||||
| 20 | or an account number in combination with any required | ||||||
| 21 | security code, access code, or password that would permit | ||||||
| 22 | access to an individual's financial account;
| ||||||
| 23 | (4) medical data;
| ||||||

| 1 | (5) military identification number; and
| ||||||
| 2 | (6) official Department of Defense documents, | ||||||
| 3 | including service records and records of veterans who have | ||||||
| 4 | passed away.
| ||||||
| 5 | Any person who knowingly violates this Section commits a Class | ||||||
| 6 | 4 felony.
| ||||||
| 7 | Section 10. The Department of Veterans Affairs Act is | ||||||
| 8 | amended by adding Section 20 as follows: | ||||||
| 9 | (20 ILCS 2805/20 new) | ||||||
| 10 | Sec. 20. Removal of sensitive material. No employee of the | ||||||
| 11 | Department of Veterans Affairs may remove electronic or paper | ||||||
| 12 | copies of sensitive material from Department offices without | ||||||
| 13 | the express authorization of the Director. For the purposes of | ||||||
| 14 | this Section, "sensitive material" means an individual's first | ||||||
| 15 | name or first initial and last name in combination with any one | ||||||
| 16 | or more of the following data elements, when either the name or | ||||||
| 17 | the data elements are not encrypted or redacted: | ||||||
| 18 | (1) social security number;
| ||||||

| 9 | becoming law.
