| 1 | AN ACT concerning regulation.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Private Sewage Disposal Licensing Act is | ||||||
| 5 | amended by changing Section 5b as follows: | ||||||
| 6 | (225 ILCS 225/5b) | ||||||
| 7 | Sec. 5b. Licensure required for the maintenance of
pumping, | ||||||
| 8 | hauling, and disposal of wastes from portable toilets, holding | ||||||
| 9 | tanks, and potable handwashing units; cleanliness standards. | ||||||
| 10 | (a) The Department shall by rule, establish and issue a | ||||||
| 11 | separate license, independent of any other license issued under | ||||||
| 12 | this Act, for the pumping, hauling, and disposal of wastes | ||||||
| 13 | removed from the sewage disposal systems of portable toilets, | ||||||
| 14 | holding tanks, and portable, potable handwashing units and the | ||||||
| 15 | cleaning, sanitizing, and maintenance of portable toilets, | ||||||
| 16 | holding tanks, and portable, potable handwashing units to | ||||||
| 17 | qualified businesses
persons
responsible for the pumping, | ||||||
| 18 | hauling, and disposal of wastes removed from the sewage | ||||||
| 19 | disposal systems of portable toilets, holding tanks, and | ||||||
| 20 | portable, potable handwashing units and the cleaning, | ||||||
| 21 | sanitizing, and maintenance of portable toilets, holding | ||||||
| 22 | tanks, and portable, potable handwashing units. These rules | ||||||
| 23 | shall concern, but not be limited to, all of the following | ||||||
| |||||||
| |||||||
| 1 | areas: | ||||||
| 2 | (1) License duration and expiration, renewal, | ||||||
| 3 | reinstatement, and inactive status. | ||||||
| 4 | (2) All fees relating to initial licensure and renewal. | ||||||
| 5 | (3) Licensure application form and process. | ||||||
| 6 | (4) Violations and penalties. | ||||||
| 7 | (5) Exemptions and waivers. | ||||||
| 8 | (6) Ventilation, safety, and security requirements of | ||||||
| 9 | portable toilet units and the sewage disposal systems of | ||||||
| 10 | portable toilet units.
| ||||||
| 11 | (a-5) The Department shall by rule, establish and issue a | ||||||
| 12 | certificate of registration as a portable sanitation | ||||||
| 13 | technician for any employee of a business licensed under this | ||||||
| 14 | Section who engages in the servicing of portable toilets, | ||||||
| 15 | holding tanks, and portable, potable handwashing units and the | ||||||
| 16 | cleaning, sanitizing, and maintenance of portable toilets, | ||||||
| 17 | holding tanks, and portable, potable handwashing units. | ||||||
| 18 | Beginning 6 months after the date of the adoption of Department | ||||||
| 19 | rules implementing the provisions of this amendatory Act of the | ||||||
| 20 | 95th General Assembly, no person may engage in the servicing of | ||||||
| 21 | portable toilets in a manner that does not comply with the | ||||||
| 22 | requirements of this Act and the rules established by the | ||||||
| 23 | Department under this Act concerning the issuance of a | ||||||
| 24 | certificate of registration as a portable sanitation | ||||||
| 25 | technician. Prior to a registrant's initial renewal of his or | ||||||
| 26 | her certificate of registration, the registrant must complete a | ||||||
| |||||||
| |||||||
| 1 | certification program approved by the Department.
| ||||||
| 2 | (b) Beginning 6 months after the date of the adoption of | ||||||
| 3 | Department rules implementing the provisions of this | ||||||
| 4 | amendatory Act of the 95th General Assembly, no person or | ||||||
| 5 | business may engage in the pumping, hauling, and disposal of | ||||||
| 6 | wastes removed from the sewage disposal systems of portable | ||||||
| 7 | toilets, holding tanks, and portable, potable handwashing | ||||||
| 8 | units and the cleaning, sanitizing, and maintenance of portable | ||||||
| 9 | toilets, holding tanks, and portable, potable handwashing | ||||||
| 10 | units without being licensed or certified under this Section.
| ||||||
| 11 | Beginning 6 months after the date of the adoption of Department | ||||||
| 12 | rules concerning the establishment and issuance of a license | ||||||
| 13 | for the pumping, hauling, and disposal of wastes removed from | ||||||
| 14 | the sewage disposal systems of portable toilets, no person may | ||||||
| 15 | engage in the pumping, hauling, or disposal of wastes removed | ||||||
| 16 | from the sewage disposal systems of portable toilets in a | ||||||
| 17 | manner that does not comply with the requirements of this Act | ||||||
| 18 | and the rules established by the Department under this Act | ||||||
| 19 | concerning the pumping, hauling, and disposal of wastes removed | ||||||
| 20 | from the sewage disposal systems of portable toilets.
| ||||||
| 21 | (c) The Department shall require the successful completion | ||||||
| 22 | of an examination, prescribed by the Department, prior to | ||||||
| 23 | licensure. The Department may accept the Portable Sanitation | ||||||
| 24 | Association International's Health and Safety Certification | ||||||
| 25 | Program as an acceptable educational and testing program. | ||||||
| 26 | (d) The Department shall consider and make any necessary | ||||||
| |||||||
| |||||||
| 1 | amendments to the private sewage disposal code in relation to a | ||||||
| 2 | license issued for the pumping, hauling, and disposal of wastes | ||||||
| 3 | removed from the sewage disposal systems of portable toilets, | ||||||
| 4 | holding tanks, and portable, potable handwashing units and the | ||||||
| 5 | cleaning, sanitizing, and maintenance of portable toilets and | ||||||
| 6 | portable, potable handwashing units. | ||||||
| 7 | (e) The Department shall establish and enforce standards of | ||||||
| 8 | cleanliness for companies that sell, lease, rent, or otherwise | ||||||
| 9 | maintain portable toilet units and portable, potable | ||||||
| 10 | handwashing units for commercial purposes, which shall | ||||||
| 11 | include, but not be limited to, the following requirements: | ||||||
| 12 | (1) Each unit shall be thoroughly cleaned at each | ||||||
| 13 | pumping, including all parts of the unit, which are the | ||||||
| 14 | urinal, tank, walls, floors, door, and roof. | ||||||
| 15 | (2) Soap or anti-bacterial hand cleaner and paper | ||||||
| 16 | products shall be refilled in each unit at each pumping, if | ||||||
| 17 | required.
| ||||||
| 18 | (3) After a unit is cleaned, it shall be inspected to | ||||||
| 19 | ensure compliance with Department rules concerning the | ||||||
| 20 | ventilation, safety, and security of the unit. | ||||||
| 21 | (4) A company shall designate at least one | ||||||
| 22 | representative who shall be responsible for ensuring that | ||||||
| 23 | each unit maintained by the company meets the standards of | ||||||
| 24 | cleanliness set forth in this subsection (d) and any | ||||||
| 25 | additional standards established by the Department. | ||||||
| 26 | Companies that have designated a person to clean units may | ||||||
| |||||||
| |||||||
| 1 | not designate the same person the responsibility of | ||||||
| 2 | ensuring unit compliance with the standards of | ||||||
| 3 | cleanliness. | ||||||
| 4 | (5) Those persons engaging in cleaning units shall wear | ||||||
| 5 | protective equipment and be trained in proper procedures | ||||||
| 6 | for sanitation and self-protection.

| 8 | Section 99. Effective date. This Act takes effect upon | ||||||
| 9 | becoming law.
