| AMENDMENT NO. ______. Amend House Bill 1303 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Private Sewage Disposal Licensing Act is |
5 |
| amended by changing Section 5b as follows: |
6 |
| (225 ILCS 225/5b) |
7 |
| Sec. 5b. Licensure required for the maintenance of
pumping, |
8 |
| hauling, and disposal of wastes from portable toilets , holding |
9 |
| tanks, and potable handwashing units ; cleanliness standards. |
10 |
| (a) The Department shall by rule, establish and issue a |
11 |
| separate license, independent of any other license issued under |
12 |
| this Act, for the pumping, hauling, and disposal of wastes |
13 |
| removed from the sewage disposal systems of portable toilets , |
14 |
| holding tanks, and portable, potable handwashing units and the |
15 |
| cleaning, sanitizing, and maintenance of portable toilets, |
16 |
| holding tanks, and portable, potable handwashing units to |
|

| qualified businesses
persons
responsible for the pumping, |
2 |
| hauling, and disposal of wastes removed from the sewage |
3 |
| disposal systems of portable toilets , holding tanks, and |
4 |
| portable, potable handwashing units and the cleaning, |
5 |
| sanitizing, and maintenance of portable toilets, holding |
6 |
| tanks, and portable, potable handwashing units . These rules |
7 |
| shall concern, but not be limited to, all of the following |
8 |
| areas: |
9 |
| (1) License duration and expiration, renewal, |
10 |
| reinstatement, and inactive status. |
11 |
| (2) All fees relating to initial licensure and renewal. |
12 |
| (3) Licensure application form and process. |
13 |
| (4) Violations and penalties. |
14 |
| (5) Exemptions and waivers. |
15 |
| (6) Ventilation, safety, and security requirements of |
16 |
| portable toilet units and the sewage disposal systems of |
17 |
| portable toilet units.

18 |
| (a-5) The Department shall by rule, establish and issue a |
19 |
| certificate of registration as a portable sanitation |
20 |
| technician for any employee of a business licensed under this |
21 |
| Section who engages in the servicing of portable toilets, |
22 |
| holding tanks, and portable, potable handwashing units and the |
23 |
| cleaning sanitizing, and maintenance of portable toilets, |
24 |
| holding tanks, and portable, potable handwashing units. |
25 |
| Beginning 6 months after the date of the adoption of Department |
26 |
| rules implementing the provisions of this amendatory Act of the |

| 95th General Assembly, no person may engage in the servicing of |
2 |
| portable toilets in a manner that does not comply with the |
3 |
| requirements of this Act and the rules established by the |
4 |
| Department under this Act concerning the issuance of a |
5 |
| certificate of registration as a portable sanitation |
6 |
| technician. Prior to a registrant's initial renewal of his or |
7 |
| her certificate of registration, the registrant must complete a |
8 |
| certification program approved by the Department.

| (b) Beginning 6 months after the date of the adoption of |
10 |
| Department rules implementing the provisions of this |
11 |
| amendatory Act of the 95th General Assembly, no person or |
12 |
| business may engage in the pumping, hauling, and disposal of |
13 |
| wastes removed from the sewage disposal systems of portable |
14 |
| toilets, holding tanks, and portable, potable handwashing |
15 |
| units and the cleaning, sanitizing, and maintenance of portable |
16 |
| toilets, holding tanks, and portable, potable handwashing |
17 |
| units without being licensed or certified under this Section.

| Beginning 6 months after the date of the adoption of Department |
19 |
| rules concerning the establishment and issuance of a license |
20 |
| for the pumping, hauling, and disposal of wastes removed from |
21 |
| the sewage disposal systems of portable toilets, no person may |
22 |
| engage in the pumping, hauling, or disposal of wastes removed |
23 |
| from the sewage disposal systems of portable toilets in a |
24 |
| manner that does not comply with the requirements of this Act |
25 |
| and the rules established by the Department under this Act |
26 |
| concerning the pumping, hauling, and disposal of wastes removed |

| from the sewage disposal systems of portable toilets.
|

| (c) The Department shall require the successful completion |
3 |
| of an examination, prescribed by the Department, prior to |
4 |
| licensure. The Department may accept the Portable Sanitation |
5 |
| Association International's Health and Safety Certification |
6 |
| Program as an acceptable educational and testing program. |
7 |
| (d) The Department shall consider and make any necessary |
8 |
| amendments to the private sewage disposal code in relation to a |
9 |
| license issued for the pumping, hauling, and disposal of wastes |
10 |
| removed from the sewage disposal systems of portable toilets , |
11 |
| holding tanks, and portable, potable handwashing units and the |
12 |
| cleaning, sanitizing, and maintenance of portable toilets and |
13 |
| portable, potable handwashing units . |
14 |
| (e) The Department shall establish and enforce standards of |
15 |
| cleanliness for companies that sell, lease, rent, or otherwise |
16 |
| maintain portable toilet units and portable, potable |
17 |
| handwashing units for commercial purposes, which shall |
18 |
| include, but not be limited to, the following requirements: |
19 |
| (1) Each unit shall be thoroughly cleaned at each |
20 |
| pumping, including all parts of the unit, which are the |
21 |
| urinal, tank, walls, floors, door, and roof. |
22 |
| (2) Soap or anti-bacterial hand cleaner and paper |
23 |
| products shall be refilled in each unit at each pumping, if |
24 |
| required.
|
25 |
| (3) After a unit is cleaned, it shall be inspected to |
26 |
| ensure compliance with Department rules concerning the |

| ventilation, safety, and security of the unit. |
2 |
| (4) A company shall designate at least one |
3 |
| representative who shall be responsible for ensuring that |
4 |
| each unit maintained by the company meets the standards of |
5 |
| cleanliness set forth in this subsection (d) and any |
6 |
| additional standards established by the Department. |
7 |
| Companies that have designated a person to clean units may |
8 |
| not designate the same person the responsibility of |
9 |
| ensuring unit compliance with the standards of |
10 |
| cleanliness. |
11 |
| (5) Those persons engaging in cleaning units shall wear |
12 |
| protective equipment and be trained in proper procedures |
13 |
| for sanitation and self-protection.

| Section 99. Effective date. This Act takes effect upon |
16 |
| becoming law.".
