| AN ACT concerning education.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The School Code is amended by adding Section |
| 5 |
| 34-18.34 as follows:
|

| (105 ILCS 5/34-18.34 new) |

| Sec. 34-18.34. Recess required in elementary school. The |
| 8 |
| board shall require that schools provide recess for all |
| 9 |
| students in kindergarten through grade 8. A recess must be at |
| 10 |
| least 10 minutes in length. If the principal determines that |
| 11 |
| the weather is inclement, the principal shall direct that a |
| 12 |
| recess be held indoors. The principal shall ensure that |
| 13 |
| students are given the opportunity to engage in physical |
| 14 |
| exercise during each recess. The time required for recesses by |
| 15 |
| this Section is included in the minimum number of hours |
| 16 |
| necessary to constitute a full day of attendance under Section |
| 17 |
| 18-8.05 of this Code.
