SYNOPSIS AS INTRODUCED:
 
105 ILCS 230/5-30

    Amends the School Construction Law. With respect to the priority of school construction projects, in the 2nd priority concerning projects designed to alleviate a shortage of classrooms due to population growth or to replace aging school buildings, adds an exception for those schools designated as or determined to be historically or architecturally significant. Adds, as part of the 4th priority, rehabilitation of school facilities determined to be severe and continuing health or life safety hazards. Effective January 1, 2008.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Construction Law is amended by
5 changing Section 5-30 as follows:
 
6     (105 ILCS 230/5-30)
7     Sec. 5-30. Priority of school construction projects. The
8 State Board of Education shall develop standards for the
9 determination of priority needs concerning school construction
10 projects based upon approved district facilities plans. Such
11 standards shall call for prioritization based on the degree of
12 need and project type in the following order:
13         (1) Replacement or reconstruction of school buildings
14     destroyed or damaged by flood, tornado, fire, earthquake,
15     or other disasters, either man-made or produced by nature;
16         (2) Projects designed to alleviate a shortage of
17     classrooms due to population growth or to replace aging
18     school buildings, with the exception of those schools
19     designated as or determined to be historically or
20     architecturally significant;
21         (3) Projects resulting from interdistrict
22     reorganization of school districts contingent on local
23     referenda;

1         (4) Replacement, rehabilitation, or reconstruction of
2     school facilities determined to be severe and continuing
3     health or life safety hazards;
4         (5) Alterations necessary to provide accessibility for
5     qualified individuals with disabilities; and
6         (6) Other unique solutions to facility needs.
7 The State Board of Education may not make any material changes
8 to the standards in effect on May 18, 2004, unless the State
9 Board of Education is specifically authorized by law.

11     Section 99. Effective date. This Act takes effect January
12 1, 2008.
