SYNOPSIS AS INTRODUCED:
 
225 ILCS 650/9   from Ch. 56 1/2, par. 309

    Amends the Meat and Poultry Inspection Act. Allows for the slaughter of an animal that has not been subject to an antemortem inspection in cases where (i) the animal has gotten loose, (ii) the animal poses a risk to the public health while it is loose, and (iii) an inspector is not immediately available to conduct an antemortem inspection. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Meat and Poultry Inspection Act is amended
5 by changing Section 9 as follows:
 
6     (225 ILCS 650/9)  (from Ch. 56 1/2, par. 309)
7     Sec. 9. Antemortem Inspection.
8     (a) The Director shall, wherever slaughter operations are
9 conducted at an establishment, cause antemortem inspection to
10 be made by inspectors where and to the extent it determines
11 necessary regarding all animals and poultry intended for human
12 food. The owner or operator of any such establishment shall
13 furnish satisfactory facilities and assistance as may be
14 required by the Director to facilitate such antemortem
15 inspection. Facilities shall also be furnished for holding
16 animals or poultry for further clinical examination. Such
17 animals or poultry held for further inspection shall be
18 identified as "Illinois Suspect" in a manner determined by the
19 Director. Such reinspection shall be conducted by a licensed
20 and approved veterinarian and if a finding is made that the
21 animals or poultry show no symptoms of disease or other
22 abnormal conditions, the animals or poultry may be released for
23 slaughter. Upon finding symptoms of disease or other abnormal

1 conditions which would render the animals or poultry unfit for
2 human food, the animals or poultry shall be tagged or
3 permanently identified as "Illinois Inspected and Condemned"
4 and unfit for human food and shall be disposed of in a manner
5 as prescribed by the Director. Any person who slaughters for
6 human food such condemned animals or poultry is guilty of a
7 Class 4 felony. No owner or person shall be required to hold
8 animals or poultry for a longer period than 72 hours.
9     (b) Notwithstanding subsection (a) of this Section, a
10 slaughterer may slaughter an animal that has not been subject
11 to an antemortem inspection in cases where (i) the animal has
12 gotten loose, (ii) the animal poses a risk to the public health
13 while it is loose, and (iii) an inspector is not immediately
14 available to conduct an antemortem inspection.

16     Section 99. Effective date. This Act takes effect upon
