| AMENDMENT TO HOUSE BILL 1768

| AMENDMENT NO. ______. Amend House Bill 1768 on page 3, by |

| replacing lines 9 through 13 with the following:

| "(h) Any person not in compliance with this Section is |
| 5 |
| guilty of a petty offense. All subsequent violations of this |
| 6 |
| Section are a Class C misdemeanor. The fine for subsequent |
| 7 |
| violations shall be at least $100, in addition to court costs. |
| 8 |
| Of each fine collected under this Section, $5 shall be |
| 9 |
| deposited into the Circuit Clerk Operation and Administrative |
| 10 |
| Fund created by the Clerk of the Circuit Court to be used to |
| 11 |
| offset the costs incurred by the Clerk of the Circuit Court in |
| 12 |
| performing the additional duties required to collect and |
| 13 |
| disburse funds to entities of State and local government as |
| 14 |
| provided by law. The balance of any fines collected for a |
| 15 |
| subsequent offense shall be remitted by the Clerk of the |
| 16 |
| Circuit Court to the Illinois Department of Natural Resources. |
| 17 |
| The Illinois Department of Natural Resources shall deposit the |
