AMENDMENT TO HOUSE BILL 1769

    AMENDMENT NO. ______. Amend House Bill 1769 by replacing

everything after the enacting clause with the following:

    "Section 5. The Illinois Vehicle Code is amended  by adding 
5
Section 11-1430 as follows:

    (625 ILCS 5/11-1430  new)
7
    Sec. 11-1430. No smoking with young children in the 
8
vehicle.

    (a) A person may not smoke in a vehicle if any person in 
10
the vehicle is a child 8 years of age or younger.
11
    (b) A violation of this Section shall not be considered 
12
evidence of negligence, shall not limit the liability of an 
13
insurer, and shall not diminish any recovery for damages 
14
arising out of the ownership, maintenance, or operation of a 
15
motor vehicle.

    (c) A violation of this Section is a petty offense

punishable by a fine of not more than $25.

    (d) A law enforcement officer may not search or inspect a 
3
motor vehicle, its contents, the driver, or a passenger solely 
4
because of a violation of this Section.".
