Amends the Veterinary Medicine and Surgery Practice Act of 2004. Requires any person licensed under the Act who dispenses any prescription drug to provide the client to whom the drug is dispensed with a client information sheet that sets forth certain information about the drug at the time of dispensation. Effective January 1, 2008.

| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Veterinary Medicine and Surgery Practice Act |
5 |
| of 2004 is amended by changing Section 17 as follows:
|

| Sec. 17. Dispensation of drugs; client information sheet.
|

| (a) In this Section: |
10 |
| "Client information sheet" means a paper given to a |
11 |
| veterinarian by a prescription drug manufacturer, as required |
12 |
| by the Center for Veterinary Medicine of the federal Food and |
13 |
| Drug Administration, for the purpose of communicating |
14 |
| important risk information to clients so that the owners of an |
15 |
| animal are provided with vital product safety information, |
16 |
| including without limitation precautions, contraindications, |
17 |
| signs of a possible adverse reaction, and steps to take in the |
18 |
| event of an adverse reaction to the prescription drug. |
19 |
| "Drug" has the meaning given to that term in the Pharmacy |
20 |
| Practice Act of 1987. |
21 |
| "Good faith" has the meaning given to that term in |
22 |
| subsection (v) of Section 102 of the
Illinois Controlled |
23 |
| Substances Act.

| "Medicine" has the meaning given to that term in the |
2 |
| Pharmacy Practice Act of 1987.
|

| (b) Any person licensed under this Act who dispenses any |
4 |
| drug
or medicine shall dispense such drug or medicine in good |
5 |
| faith and shall
affix to the container containing the same a |
6 |
| label indicating: (a) the date
on which such drug or medicine |
7 |
| is dispensed, (b) the name of the owner,
(c) the last name of |
8 |
| the person dispensing such drug or medicine, (d)
directions for |
9 |
| use thereof, including dosage and quantity, and (e) the
|
10 |
| proprietary or generic name of the drug or medicine, except as |
11 |
| otherwise
authorized by rules of the Department. This Section |
12 |
| shall not apply to
drugs and medicines that are in a container |
13 |
| which bears a label of the
manufacturer with information |
14 |
| describing its contents that are in
compliance with |
15 |
| requirements of the Federal Food, Drug, and Cosmetic Act or
the |
16 |
| Illinois Food, Drug and Cosmetic Act , approved June 29, 1967, |
17 |
| as
amended, and which are dispensed without consideration by a |
18 |
| practitioner
licensed under this Act. "Drug" and "medicine" |
19 |
| have the meanings ascribed
to them in the Pharmacy Practice Act |
20 |
| of 1987, as amended, and "good faith"
has the meaning ascribed |
21 |
| to it in subsection (v) of Section 102 of the
"Illinois |
22 |
| Controlled Substances Act", approved August 16, 1971, as |
23 |
| amended .

| (c) Any person licensed under this Act who dispenses any |
25 |
| prescription drug must provide the client to whom the drug is |
26 |
| dispensed with a client information sheet at the time of |
