| Section 10. The Illinois Municipal Code is amended by |

| adding Section 11-12-14 as follows: |

| (65 ILCS 5/11-12-14 new) |

| Sec. 11-12-14. Impact study; development. Before |
5 |
| authorizing any new residential or commercial development |
6 |
| project, a municipality must conduct an impact study detailing |
7 |
| the effects of the proposed development on local infrastructure |
8 |
| and on all affected taxing districts. The study shall be |
9 |
| non-binding. The municipality must file a copy of the study |
10 |
| with the Department of Commerce and Economic Opportunity, which |
11 |
| shall be responsible for monitoring the municipal impact |
12 |
| studies. A home rule unit may not regulate development in a |
13 |
| manner that is inconsistent with this Section. This Section is |
14 |
| limitation under subsection (i) of Section 6 of Article VII of |
15 |
| the Illinois Constitution on the concurrent exercise by home |
16 |
| rule units of powers and functions exercised by the State.

| Section 90. The State Mandates Act is amended by adding |
18 |
| Section 8.31 as follows: |

| Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8 |
21 |
| of this Act, no reimbursement by the State is required for the |
22 |
| implementation of any mandate created by this amendatory Act of |
