| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois, |

| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by changing |
5 |
| Section 19-2 as follows:
|

| (720 ILCS 5/19-2) (from Ch. 38, par. 19-2)

| Sec. 19-2. Possession of burglary tools.
|
8 |
| (a) A person commits
the offense of possession of burglary |
9 |
| tools when he
possesses any key, tool, instrument, device, or |
10 |
| any explosive, suitable for
use in breaking into a building, |
11 |
| housetrailer, watercraft, aircraft, motor
vehicle as defined |
12 |
| in The Illinois Vehicle Code, railroad car, or any
depository |
13 |
| designed for the safekeeping of property, or any part thereof,
|
14 |
| with intent to enter any such place and with intent to commit |
15 |
| therein a
felony or theft. The trier of fact may infer from the |
16 |
| possession of a key designed for lock bumping an intent to |
17 |
| commit a felony or theft; however, this inference does not |
18 |
| apply to any peace officer or other employee of a law |
19 |
| enforcement agency, or to any person or agency licensed under |
20 |
| the Private Detective, Private Alarm, Private Security, |
21 |
| Fingerprint Vendor, and Locksmith Act of 2004. For the purposes |
22 |
| of this Section, "lock bumping" means a lock picking technique |
23 |
| for opening a pin tumbler lock using a specially-crafted |
