1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by changing
5 Section 19-2 as follows:
 
6     (720 ILCS 5/19-2)  (from Ch. 38, par. 19-2)
7     Sec. 19-2. Possession of burglary tools.
8     (a) A person commits the offense of possession of burglary
9 tools when he possesses any key, tool, instrument, device, or
10 any explosive, suitable for use in breaking into a building,
11 housetrailer, watercraft, aircraft, motor vehicle as defined
12 in The Illinois Vehicle Code, railroad car, or any depository
13 designed for the safekeeping of property, or any part thereof,
14 with intent to enter any such place and with intent to commit
15 therein a felony or theft. The trier of fact may infer from the
16 possession of a key designed for lock bumping an intent to
17 commit a felony or theft; however, this inference does not
18 apply to any peace officer or other employee of a law
19 enforcement agency, or to any person or agency licensed under
20 the Private Detective, Private Alarm, Private Security,
21 Fingerprint Vendor, and Locksmith Act of 2004. For the purposes
22 of this Section, "lock bumping" means a lock picking technique
23 for opening a pin tumbler lock using a specially-crafted

2     (b) Sentence.
3     Possession of burglary tools in violation of this Section
4 is a Class 4 felony.
