| AN ACT concerning civil law.

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Non-Support Punishment Act is amended by |
| 5 |
| changing Section 10 as follows:
|

| Sec. 10. Proceedings. Proceedings under this Act may be by |
| 8 |
| indictment or
information. No proceeding may be brought under |
| 9 |
| Section 15 against a person
whose court or administrative order |
| 10 |
| for support was entered by default, unless
the
the indictment |
| 11 |
| or information specifically alleges that the person has
|
| 12 |
| knowledge of the existence of the order for support and that |
| 13 |
| the person has the
ability to pay the support. |
