| AN ACT concerning local government.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Township Code is amended by changing Section |
| 5 |
| 120-5 as follows:
|
| 6 |
| (60 ILCS 1/120-5)
|
| 7 |
| Sec. 120-5. Power to acquire park land; inapplicable to |
| 8 |
| church.
|
| 9 |
| (a) A township, acting through the
the township board, may |
| 10 |
| acquire lands (not
exceeding for any one park 25 acres in |
| 11 |
| extent, unless received as a gift) to be
set apart and forever |
| 12 |
| held and maintained and improved as public parks for the
free |
| 13 |
| use of the public. |
| 14 |
| (b) This Section does not apply to property owned by a |
| 15 |
| church or any
organization owned, operated, or controlled by or |
| 16 |
| affiliated with a church,
regardless of whether the property is |
| 17 |
| subject to a lease, occupancy agreement,
or other contract, |
| 18 |
| agreement, or arrangement with a person or entity other than
a |
| 19 |
| church.
