AMENDMENT TO HOUSE BILL 3425

    AMENDMENT NO. ______. Amend House Bill 3425 by replacing

everything after the enacting clause with the following:

    "Section 5. The Wildlife Code is amended  by adding Section 
5
2.39 as follows:

    (520 ILCS 5/2.39  new)
7
    Sec. 2.39. Local control of deer population. A municipality 
8
or other unit of local government that conducts a scientific 
9
study, of at least 4 years, on controlling the deer population, 
10
using a method in addition to taking of the deer, in that 
11
municipality or other unit of local government and concludes, 
12
as a result of that study, that the deer population of the 
13
municipality or other unit of local government may be managed, 
14
using that alternative method, in a way that results in 
15
sustainable deer populations, then the Department must  permit 
16
the municipality or other unit of local government to implement

the alternative method of deer population control on the lands 
2
of that municipality or other unit of local government at the 
3
municipality's or unit of local government's own expense. The 
4
municipality or unit of local government must report to the 
5
Department, on an annual basis, the local deer population 
6
count, as required by administrative rule.

    Section 99. Effective date. This Act takes effect upon 
8
becoming law.".
