Amends the Electric Service Customer Choice and Rate Relief Law of 1997 in the Public Utilities Act. Requires that, within 30 days after the effective date of the amendatory Act, the Commission must submit a formal proposal to the Governor and the General Assembly for creation of a competitive market for residential electric consumers in Illinois that the Commission shall implement within 45 days after submission of the proposal. Effective immediately.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by adding |
5 |
| Section 16-120.1 as follows: |
6 |
| (220 ILCS 5/16-120.1 new)
|
7 |
| Sec. 16-120.1. Competitive market proposal. Within 30 days |
8 |
| after the effective date of this amendatory Act of the 95th |
9 |
| General Assembly, the Illinois Commerce Commission shall |
10 |
| submit a formal proposal to the Governor and the General |
11 |
| Assembly for creation of a competitive market for residential |
12 |
| electric consumers in Illinois that the Commission shall |
13 |
| implement within 45 days after submission of the proposal.

| Section 99. Effective date. This Act takes effect upon |
15 |
| becoming law.
