1     AN ACT in relation to budget implementation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

ARTICLE 1. SHORT TITLE; PURPOSE

 
5     Section 1-1. Short title. This Act may be cited as the
6 FY2009 Budget Implementation (Finance) Act.
 
7     Section 1-5. Purpose. It is the purpose of this Act to make
8 changes in State programs that are necessary to implement the
9 Governor's Fiscal Year 2009 budget recommendations concerning
10 finance.

ARTICLE 5. AMENDATORY PROVISIONS

 
12     Section 5-20. The State Finance Act is amended by changing
13 Sections 6z-63, 6z-64, and 13.2 as follows:
 
14     (30 ILCS 105/6z-63)
15     Sec. 6z-63. The Professional Services Fund.
16     (a) The Professional Services Fund is created as a
17 revolving fund in the State treasury. The following moneys
18 shall be deposited into the Fund:
19         (1) amounts authorized for transfer to the Fund from

1     the General Revenue Fund and other State funds (except for
2     funds classified by the Comptroller as federal trust funds
3     or State trust funds) pursuant to State law or Executive
4     Order;
5         (2) federal funds received by the Department of Central
6     Management Services (the "Department") as a result of
7     expenditures from the Fund;
8         (3) interest earned on moneys in the Fund; and
9         (4) receipts or inter-fund transfers resulting from
10     billings issued by the Department to State agencies for the
11     cost of professional services rendered by the Department
12     that are not compensated through the specific fund
13     transfers authorized by this Section.
14     (b) Moneys in the Fund may be used by the Department for
15 reimbursement or payment for:
16         (1) providing professional services to State agencies
17     or other State entities;
18         (2) rendering other services to State agencies at the
19     Governor's direction or to other State entities upon
20     agreement between the Director of Central Management
21     Services and the appropriate official or governing body of
22     the other State entity; or
23         (3) providing for payment of administrative and other
24     expenses incurred by the Department in providing
25     professional services.
26     (c) State agencies or other State entities may direct the

1 Comptroller to process inter-fund transfers or make payment
2 through the voucher and warrant process to the Professional
3 Services Fund in satisfaction of billings issued under
4 subsection (a) of this Section.
5     (d) Reconciliation. For the fiscal year beginning on July
6 1, 2004 only, the Director of Central Management Services (the
7 "Director") shall order that each State agency's payments and
8 transfers made to the Fund be reconciled with actual Fund costs
9 for professional services provided by the Department on no less
10 than an annual basis. The Director may require reports from
11 State agencies as deemed necessary to perform this
12 reconciliation.
13     (e) The following amounts are authorized for transfer into
14 the Professional Services Fund for the fiscal year beginning
15 July 1, 2004:

19 2006, in addition to any other transfers that may be provided
20 for by law, at the direction of and upon notification from the
21 Director of Central Management Services, the State Comptroller
22 shall direct and the State Treasurer shall transfer amounts
23 into the Professional Services Fund from the designated funds
24 not exceeding the following totals:

18 the State Treasurer shall transfer from each designated fund
19 into the Professional Services Fund amounts equal to one-fourth
20 of each of the following totals:

24     (e-15) Notwithstanding any other provision of State law to
25 the contrary and in addition to any other transfers that may be

2 the Professional Services Fund according to the schedule
3 specified herein as follows:

7     One-fourth of the specified amount shall be transferred on
8 each of July 1 and October 1, 2006, or as soon as may be
9 practical thereafter, and one-half of the specified amount
10 shall be transferred on January 1, 2007, or as soon as may be
11 practical thereafter.
12     (e-20) Notwithstanding any other provision of State law to
13 the contrary, on or after July 1, 2008 and through June 30,
14 2009, in addition to any other transfers that may be provided
15 for by law, at the direction of and upon notification from the
16 Director of Central Management Services, the State Comptroller
17 shall direct and the State Treasurer shall transfer amounts
18 into the Professional Services Fund from the designated funds

15     Sec. 6z-64. The Workers' Compensation Revolving Fund.
16     (a) The Workers' Compensation Revolving Fund is created as
17 a revolving fund in the State treasury. The following moneys
18 shall be deposited into the Fund:
19         (1) amounts authorized for transfer to the Fund from
20     the General Revenue Fund and other State funds (except for
21     funds classified by the Comptroller as federal trust funds
22     or State trust funds) pursuant to State law or Executive
23     Order;
24         (2) federal funds received by the Department of Central
25     Management Services (the "Department") as a result of

1     expenditures from the Fund;
2         (3) interest earned on moneys in the Fund;
3         (4) receipts or inter-fund transfers resulting from
4     billings issued by the Department to State agencies and
5     universities for the cost of workers' compensation
6     services rendered by the Department that are not
7     compensated through the specific fund transfers authorized
8     by this Section, if any;
9         (5) amounts received from a State agency or university
10     for workers' compensation payments for temporary total
11     disability, as provided in Section 405-105 of the
12     Department of Central Management Services Law of the Civil
13     Administrative Code of Illinois; and
14         (6) amounts recovered through subrogation in workers'
15     compensation and workers' occupational disease cases.
16     (b) Moneys in the Fund may be used by the Department for
17 reimbursement or payment for:
18         (1) providing workers' compensation services to State
19     agencies and State universities; or
20         (2) providing for payment of administrative and other
21     expenses incurred by the Department in providing workers'
22     compensation services.
23     (c) State agencies may direct the Comptroller to process
24 inter-fund transfers or make payment through the voucher and
25 warrant process to the Workers' Compensation Revolving Fund in
26 satisfaction of billings issued under subsection (a) of this

1 Section.
2     (d) Reconciliation. For the fiscal year beginning on July
3 1, 2004 only, the Director of Central Management Services (the
4 "Director") shall order that each State agency's payments and
5 transfers made to the Fund be reconciled with actual Fund costs
6 for workers' compensation services provided by the Department
7 and attributable to the State agency and relevant fund on no
8 less than an annual basis. The Director may require reports
9 from State agencies as deemed necessary to perform this
10 reconciliation.
11     (d-5) Notwithstanding any other provision of State law to
12 the contrary, on or after July 1, 2005 and until June 30, 2006,
13 in addition to any other transfers that may be provided for by
14 law, at the direction of and upon notification of the Director
15 of Central Management Services, the State Comptroller shall
16 direct and the State Treasurer shall transfer amounts into the
17 Workers' Compensation Revolving Fund from the designated funds
18 not exceeding the following totals:

3     Sec. 13.2. Transfers among line item appropriations.
4     (a) Transfers among line item appropriations from the same
5 treasury fund for the objects specified in this Section may be
6 made in the manner provided in this Section when the balance
7 remaining in one or more such line item appropriations is
8 insufficient for the purpose for which the appropriation was
9 made.
10     (a-1) No transfers may be made from one agency to another
11 agency, nor may transfers be made from one institution of
12 higher education to another institution of higher education.
13     (a-2) Except as otherwise provided in this Section,
14 transfers may be made only among the objects of expenditure
15 enumerated in this Section, except that no funds may be
16 transferred from any appropriation for personal services, from
17 any appropriation for State contributions to the State
18 Employees' Retirement System, from any separate appropriation
19 for employee retirement contributions paid by the employer, nor
20 from any appropriation for State contribution for employee
21 group insurance. During State fiscal year 2005, an agency may
22 transfer amounts among its appropriations within the same
23 treasury fund for personal services, employee retirement
24 contributions paid by employer, and State Contributions to
25 retirement systems; notwithstanding and in addition to the

1 transfers authorized in subsection (c) of this Section, the
2 fiscal year 2005 transfers authorized in this sentence may be
3 made in an amount not to exceed 2% of the aggregate amount
4 appropriated to an agency within the same treasury fund. During
5 State fiscal years year 2007 and 2009, the Departments of
6 Children and Family Services, Corrections, Human Services, and
7 Juvenile Justice may transfer amounts among their respective
8 appropriations within the same treasury fund for personal
9 services, employee retirement contributions paid by employer,
10 and State contributions to retirement systems.
11 Notwithstanding, and in addition to, the transfers authorized
12 in subsection (c) of this Section, these transfers may be made
13 in an amount not to exceed 2% of the aggregate amount
14 appropriated to an agency within the same treasury fund.
15     (a-3) Further, if an agency receives a separate
16 appropriation for employee retirement contributions paid by
17 the employer, any transfer by that agency into an appropriation
18 for personal services must be accompanied by a corresponding
19 transfer into the appropriation for employee retirement
20 contributions paid by the employer, in an amount sufficient to
21 meet the employer share of the employee contributions required
22 to be remitted to the retirement system.
23     (b) In addition to the general transfer authority provided
24 under subsection (c), the following agencies have the specific
25 transfer authority granted in this subsection:
26     The Department of Healthcare and Family Services is

1 authorized to make transfers representing savings attributable
2 to not increasing grants due to the births of additional
3 children from line items for payments of cash grants to line
4 items for payments for employment and social services for the
5 purposes outlined in subsection (f) of Section 4-2 of the
6 Illinois Public Aid Code.
7     The Department of Children and Family Services is
8 authorized to make transfers not exceeding 2% of the aggregate
9 amount appropriated to it within the same treasury fund for the
10 following line items among these same line items: Foster Home
11 and Specialized Foster Care and Prevention, Institutions and
12 Group Homes and Prevention, and Purchase of Adoption and
13 Guardianship Services.
14     The Department on Aging is authorized to make transfers not
15 exceeding 2% of the aggregate amount appropriated to it within
16 the same treasury fund for the following Community Care Program
17 line items among these same line items: Community Care Program
18 services and Comprehensive Care Coordination Homemaker and
19 Senior Companion Services, Alternative Senior Services, Case
20 Coordination Units, and Adult Day Care Services.
21     The State Treasurer is authorized to make transfers among
22 line item appropriations from the Capital Litigation Trust
23 Fund, with respect to costs incurred in fiscal years 2002 and
24 2003 only, when the balance remaining in one or more such line
25 item appropriations is insufficient for the purpose for which
26 the appropriation was made, provided that no such transfer may

1 be made unless the amount transferred is no longer required for
2 the purpose for which that appropriation was made.
3     The State Board of Education is authorized to make
4 transfers from line item appropriations within the same
5 treasury fund for General State Aid and General State Aid -
6 Hold Harmless, provided that no such transfer may be made
7 unless the amount transferred is no longer required for the
8 purpose for which that appropriation was made, to the line item
9 appropriation for Transitional Assistance when the balance
10 remaining in such line item appropriation is insufficient for
11 the purpose for which the appropriation was made.
12     The State Board of Education is authorized to make
13 transfers between the following line item appropriations
14 within the same treasury fund: Disabled Student
15 Services/Materials (Section 14-13.01 of the School Code),
16 Disabled Student Transportation Reimbursement (Section
17 14-13.01 of the School Code), Disabled Student Tuition -
18 Private Tuition (Section 14-7.02 of the School Code),
19 Extraordinary Special Education (Section 14-7.02b of the
20 School Code), Reimbursement for Free Lunch/Breakfast Program,
21 Summer School Payments (Section 18-4.3 of the School Code), and
22 Transportation - Regular/Vocational Reimbursement (Section
23 29-5 of the School Code). Such transfers shall be made only
24 when the balance remaining in one or more such line item
25 appropriations is insufficient for the purpose for which the
26 appropriation was made and provided that no such transfer may

1 be made unless the amount transferred is no longer required for
2 the purpose for which that appropriation was made.
3     (c) The sum of such transfers for an agency in a fiscal
4 year shall not exceed 2% of the aggregate amount appropriated
5 to it within the same treasury fund for the following objects:
6 Personal Services; Extra Help; Student and Inmate
7 Compensation; State Contributions to Retirement Systems; State
8 Contributions to Social Security; State Contribution for
9 Employee Group Insurance; Contractual Services; Travel;
10 Commodities; Printing; Equipment; Electronic Data Processing;
11 Operation of Automotive Equipment; Telecommunications
12 Services; Travel and Allowance for Committed, Paroled and
13 Discharged Prisoners; Library Books; Federal Matching Grants
14 for Student Loans; Refunds; Workers' Compensation,
15 Occupational Disease, and Tort Claims; and, in appropriations
16 to institutions of higher education, Awards and Grants.
17 Notwithstanding the above, any amounts appropriated for
18 payment of workers' compensation claims to an agency to which
19 the authority to evaluate, administer and pay such claims has
20 been delegated by the Department of Central Management Services
21 may be transferred to any other expenditure object where such
22 amounts exceed the amount necessary for the payment of such
23 claims.
24     (c-1) Special provisions for State fiscal year 2003.
25 Notwithstanding any other provision of this Section to the
26 contrary, for State fiscal year 2003 only, transfers among line

1 item appropriations to an agency from the same treasury fund
2 may be made provided that the sum of such transfers for an
3 agency in State fiscal year 2003 shall not exceed 3% of the
4 aggregate amount appropriated to that State agency for State
5 fiscal year 2003 for the following objects: personal services,
6 except that no transfer may be approved which reduces the
7 aggregate appropriations for personal services within an
8 agency; extra help; student and inmate compensation; State
9 contributions to retirement systems; State contributions to
10 social security; State contributions for employee group
11 insurance; contractual services; travel; commodities;
12 printing; equipment; electronic data processing; operation of
13 automotive equipment; telecommunications services; travel and
14 allowance for committed, paroled, and discharged prisoners;
15 library books; federal matching grants for student loans;
16 refunds; workers' compensation, occupational disease, and tort
17 claims; and, in appropriations to institutions of higher
18 education, awards and grants.
19     (c-2) Special provisions for State fiscal year 2005.
20 Notwithstanding subsections (a), (a-2), and (c), for State
21 fiscal year 2005 only, transfers may be made among any line
22 item appropriations from the same or any other treasury fund
23 for any objects or purposes, without limitation, when the
24 balance remaining in one or more such line item appropriations
25 is insufficient for the purpose for which the appropriation was
26 made, provided that the sum of those transfers by a State

1 agency shall not exceed 4% of the aggregate amount appropriated
2 to that State agency for fiscal year 2005.
3     (d) Transfers among appropriations made to agencies of the
4 Legislative and Judicial departments and to the
5 constitutionally elected officers in the Executive branch
6 require the approval of the officer authorized in Section 10 of
7 this Act to approve and certify vouchers. Transfers among
8 appropriations made to the University of Illinois, Southern
9 Illinois University, Chicago State University, Eastern
10 Illinois University, Governors State University, Illinois
11 State University, Northeastern Illinois University, Northern
12 Illinois University, Western Illinois University, the Illinois
13 Mathematics and Science Academy and the Board of Higher
14 Education require the approval of the Board of Higher Education
15 and the Governor. Transfers among appropriations to all other
16 agencies require the approval of the Governor.
17     The officer responsible for approval shall certify that the
18 transfer is necessary to carry out the programs and purposes
19 for which the appropriations were made by the General Assembly
20 and shall transmit to the State Comptroller a certified copy of
21 the approval which shall set forth the specific amounts
22 transferred so that the Comptroller may change his records
23 accordingly. The Comptroller shall furnish the Governor with
24 information copies of all transfers approved for agencies of
25 the Legislative and Judicial departments and transfers
26 approved by the constitutionally elected officials of the

1 Executive branch other than the Governor, showing the amounts
2 transferred and indicating the dates such changes were entered
3 on the Comptroller's records.
4     (e) The State Board of Education, in consultation with the
5 State Comptroller, may transfer line item appropriations for
6 General State Aid from the Common School Fund to the Education
7 Assistance Fund.

9     Section 5-55. The Fire Investigation Act is amended by
10 changing Section 13.1 as follows:
 
11     (425 ILCS 25/13.1)  (from Ch. 127 1/2, par. 17.1)
12     Sec. 13.1. (a) There shall be a special fund in the State
13 Treasury known as the Fire Prevention Fund.
14     (b) The following moneys shall be deposited into the Fund:
15         (1) Moneys received by the Department of Insurance
16     under Section 12 of this Act.
17         (2) All fees and reimbursements received by the Office
18     of the State Fire Marshal.
19         (3) All receipts from boiler and pressure vessel
20     certification, as provided in Section 13 of the Boiler and
21     Pressure Vessel Safety Act.
22         (4) Such other moneys as may be provided by law.
23     (c) The moneys in the Fire Prevention Fund shall be used,
24 subject to appropriation, for the following purposes:

1         (1) Of the moneys deposited into the fund under Section
2     12 of this Act, 12.5% shall be available for the
3     maintenance of the Illinois Fire Service Institute and the
4     expenses, facilities, and structures incident thereto, and
5     for making transfers into the General Obligation Bond
6     Retirement and Interest Fund for debt service requirements
7     on bonds issued by the State of Illinois after January 1,
8     1986 for the purpose of constructing a training facility
9     for use by the Institute.
10         (2) Of the moneys deposited into the Fund under Section
11     12 of this Act, 10% shall be available for the maintenance
12     of the Chicago Fire Department Training Program and the
13     expenses, facilities and structures incident thereto, in
14     addition to any moneys payable from the Fund to the City of
15     Chicago pursuant to the Illinois Fire Protection Training
16     Act.
17         (3) For making payments to local governmental agencies
18     and individuals pursuant to Section 10 of the Illinois Fire
19     Protection Training Act.
20         (4) For the maintenance and operation of the Office of
21     the State Fire Marshal, and the expenses incident thereto.
22         (5) For the Department of Public Health to develop and
23     administer Emergency Medical Services testing programs and
24     for other Emergency Medical Services related expenses.
25         (6) (5) For any other purpose authorized by law.
26     (c-5) As soon as possible after the effective date of this

1 amendatory Act of the 95th General Assembly, the Comptroller
2 shall order the transfer and the Treasurer shall transfer
3 $2,000,000 from the Fire Prevention Fund to the Fire Service
4 and Small Equipment Fund, $9,000,000 from the Fire Prevention
5 Fund to the Fire Truck Revolving Loan Fund, and $4,000,000 from
6 the Fire Prevention Fund to the Ambulance Revolving Loan Fund.
7 Beginning on July 1, 2008, each month, or as soon as practical
8 thereafter, an amount equal to $2 from each fine received shall
9 be transferred from the Fire Prevention Fund to the Fire
10 Service and Small Equipment Fund, an amount equal to $1.50 from
11 each fine received shall be transferred from the Fire
12 Prevention Fund to the Fire Truck Revolving Loan Fund, and an
13 amount equal to $4 from each fine received shall be transferred
14 from the Fire Prevention Fund to the Ambulance Revolving Loan
15 Fund. These moneys shall be transferred from the moneys
16 deposited into the Fire Prevention Fund pursuant to Public Act
17 95-154, together with any other moneys as may be necessary to
18 carry out this mandate.
19     (d) Any portion of the Fire Prevention Fund remaining
20 unexpended at the end of any fiscal year which is not needed
21 for the maintenance and expenses of the Office of the State
22 Fire Marshal or the maintenance and expenses of the Illinois
23 Fire Service Institute, shall remain in the Fire Prevention
24 Fund for the exclusive and restricted uses provided in
25 subsections (c) and (c-5) of this Section.
26     (e) The Office of the State Fire Marshal shall keep on file

1 an itemized statement of all expenses incurred which are
2 payable from the Fund, other than expenses incurred by the
3 Illinois Fire Service Institute, and shall approve all vouchers
4 issued therefor before they are submitted to the State
5 Comptroller for payment. Such vouchers shall be allowed and
6 paid in the same manner as other claims against the State.

ARTICLE 15. ALTERNATIVE RETIREMENT CANCELLATION PAYMENT

 
9     Section 15-5. The Illinois Pension Code is amended by
10 changing Section 14-108.6 as follows:
 
11     (40 ILCS 5/14-108.6)
12     Sec. 14-108.6. Alternative retirement cancellation
13 payment.
14     (a) To be eligible for the alternative retirement
15 cancellation payment provided in this Section, a person must:
16         (1) be a member of this System who, as of June 1, 2008
17     2006, was (i) in active payroll status as an employee in a
18     position listed in subsection (b) of this Section and
19     continuously employed in a position listed in subsection
20     (b) on and after January 1, 2008 2006 and (ii) an active
21     contributor to this System with respect to that employment;
22         (2) have not previously received any retirement
23     annuity under this Article;

1         (3) in the case of persons employed in a position title
2     listed under paragraph (1) of subsection (b), be among the
3     first 500 persons to file with the Board on or before
4     August 31, 2008 2006 a written application requesting the
5     alternative retirement cancellation payment provided in
6     this Section;
7         (4) in the case of persons employed in a position title
8     listed under paragraph (2) of subsection (b), have received
9     written authorization from the director or other head of
10     his or her department and filed that authorization with the
11     system on or before August 1, 2008 2006;
12         (5) if there is a QILDRO in effect against the person,
13     file with the Board the written consent of all alternate
14     payees under the QILDRO to the election of an alternative
15     retirement cancellation payment under this Section; and
16         (6) terminate employment under this Article within one
17     month after approval of the person's application
18     requesting the alternative retirement cancellation
19     payment, but in no event later than September 30, 2008
20     2006.

3         (2) In addition, any position titles with the Speaker
4     of the House of Representatives, the Minority Leader of the
5     House of Representatives, the President of the Senate, the
6     Minority Leader of the Senate, the Attorney General, the
7     Secretary of State, the Comptroller, the Treasurer, the
8     Auditor General, the Supreme Court, the Court of Claims,
9     and each legislative agency are eligible for the
10     alternative retirement cancellation payment provided in
11     this Section.
12     (c) In lieu of any retirement annuity or other benefit
13 provided under this Article, a person who qualifies for and
14 elects to receive the alternative retirement cancellation
15 payment under this Section shall be entitled to receive a
16 one-time lump sum retirement cancellation payment equal to the
17 amount of his or her contributions to the System (including any
18 employee contributions for optional service credit and
19 including any employee contributions paid by the employer or
20 credited to the employee during disability) as of the date of
21 termination, with regular interest, multiplied by 2.
22     (d) Notwithstanding any other provision of this Article, a
23 person who receives an alternative retirement cancellation
24 payment under this Section thereby forfeits the right to any
25 other retirement or disability benefit or refund under this
26 Article, and no widow's, survivor's, or death benefit deriving

1 from that person shall be payable under this Article. Upon
2 accepting an alternative retirement cancellation payment under
3 this Section, the person's creditable service and all other
4 rights in the System are terminated for all purposes, except
5 for the purpose of determining State group life and health
6 benefits for the person and his or her survivors as provided
7 under the State Employees Group Insurance Act of 1971.
8     (e) To the extent permitted by federal law, a person who
9 receives an alternative retirement cancellation payment under
10 this Section may direct the System to pay all or a portion of
11 that payment as a rollover into another retirement plan or
12 account qualified under the Internal Revenue Code of 1986, as
13 amended.
14     (f) Notwithstanding Section 14-111, a person who has
15 received an alternative retirement cancellation payment under
16 this Section and who reenters service under this Article other
17 than as a temporary employee must repay to the System the
18 amount by which that alternative retirement cancellation
19 payment exceeded the amount of his or her refundable employee
20 contributions within 60 days of resuming employment under this
21 System. For the purposes of re-establishing creditable service
22 that was terminated upon election of the alternative retirement
23 cancellation payment, the portion of the alternative
24 retirement cancellation payment representing refundable
25 employee contributions shall be deemed a refund repayable in
26 accordance with Section 14-130.

1     (g) The Commission on Government Forecasting and
2 Accountability shall determine and report to the Governor and
3 the General Assembly, on or before January 1, 2010 2008, its
4 estimate of (1) the annual amount of payroll savings likely to
5 be realized by the State as a result of the early termination
6 of persons receiving the alternative retirement cancellation
7 payment under this Section and (2) the net annual savings or
8 cost to the State from the program of alternative retirement
9 cancellation payments under this Section.
10     The System, the Department of Central Management Services,
11 the Governor's Office of Management and Budget, and all other
12 departments shall provide to the Commission any assistance that
13 the Commission may request with respect to its report under
14 this Section. The Commission may require departments to provide
15 it with any information that it deems necessary or useful with
16 respect to its reports under this Section, including without
17 limitation information about (1) the final earnings of former
18 department employees who elected to receive alternative
19 retirement cancellation payments under this Section, (2) the
20 earnings of current department employees holding the positions
21 vacated by persons who elected to receive alternative
22 retirement cancellation payments under this Section, and (3)
23 positions vacated by persons who elected to receive alternative
24 retirement cancellation payments under this Section that have
25 not yet been refilled.
