| AN ACT concerning education.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The School Code is amended by adding Section |
| 5 |
| 34-18.37 as follows:
|

| (105 ILCS 5/34-18.37 new)
|
| 7 |
| Sec. 34-18.37. Recess required. The board shall require |
| 8 |
| that schools provide recess for all students in kindergarten |
| 9 |
| through grade 8. A recess must be at least 10 minutes in |
| 10 |
| length. If the principal determines that the weather is |
| 11 |
| inclement, the principal shall direct that a recess be held |
| 12 |
| indoors. The principal shall ensure that students are given the |
| 13 |
| opportunity to engage in physical exercise during each recess. |
| 14 |
| The time required for recesses by this Section is included in |
| 15 |
| the minimum number of hours necessary to constitute a full day |
| 16 |
| of attendance under Section 18-8.05 of this Code.
