AMENDMENT TO HOUSE BILL 4675

2     AMENDMENT NO. ______. Amend House Bill 4675 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Fire Protection District Act is amended by
5 changing Section 11f as follows:
 
6     (70 ILCS 705/11f)  (from Ch. 127 1/2, par. 31f)
7     Sec. 11f. Charge against non-residents.
8     (a) The board of trustees of a fire protection district may
9 fix, charge, and collect fees not exceeding the reasonable cost
10 of the service for all services rendered by the district
11 against persons, businesses and other entities who are not
12 residents of the fire protection district.
13     (b) Such charge may not be assessed against residents of
14 the fire protection district or persons who request fire
15 protection coverage for an unprotected area and who pay to the
16 fire protection district an amount equal to the district's Fire

1 Protection Tax pursuant to Section 4 of the Fire Protection of
2 Unprotected Area Act.
3     (c) Until January 1, 2009, the The charge for such services
4 shall be computed at a rate not to exceed $250 $125 per hour
5 per vehicle and not to exceed $70 $35 per hour per firefighter
6 responding to a call for assistance. Beginning January 1, 2009,
7 and each year thereafter, those amounts shall be increased or
8 decreased by the percentage change in the Consumer Price
9 Index-U during the previous 12-month period. An additional
10 charge may be levied to reimburse the district for
11 extraordinary expenses of materials used in rendering such
12 services. No charge shall be made for services for which the
13 total charge would be less than $50.
14     (d) All revenue from the charges assessed pursuant to this
15 Section shall be deposited to the general fund of the fire
16 protection district.
17     (e) In this Section, "Consumer Price Index-U" means the
18 index published by the Bureau of Labor Statistics of the United
19 States Department of Labor that measures the average change in
20 prices of goods and services purchased by all urban consumers,
21 United States city average, all items, 1982-84 = 100.

23     Section 99. Effective date. This Act takes effect upon
24 becoming law.".
