Amends the Department of State Police Law of the Civil Administrative Code of Illinois, the State Finance Act, and the Illinois Vehicle Code. Increases the fees to be paid when Illinois State Police escorts are required for the
safety of the motoring public. Provides that, in determining the fees, the actual time of the movement shall be the time the police escort is required to pick up the movement to the time the movement is completed with a minimum time of 3 hours, any delays or breakdowns shall be considered part of the movement time, and any fraction of an hour shall be rounded up to the next whole hour. Removes the fee for special police escorts from the permit fee calculation. Provides that the money collected for special police escorts shall be deposited into the Over Dimensional Load Police Escort Fund, a new special fund in the State treasury that shall be used by the Department of State Police for its expenses in providing police escorts and commercial vehicle enforcement activities. Makes other changes. Effective January 1, 2009.

| Be it enacted by the People of the State of Illinois,

| represented in the General Assembly:

| Section 5. The Department of State Police Law of the
Civil |
5 |
| Administrative Code of Illinois is amended by adding Section |
6 |
| 2605-410 as follows: |
7 |

| Sec. 2605-410. Over Dimensional Load Police Escort Fund. To |
9 |
| charge, collect, and receive fees or moneys as described in |
10 |
| Section 15-312 of the Illinois Vehicle Code. All fees received |
11 |
| by the Department under Section 15-312 of the Illinois Vehicle |
12 |
| Code shall be deposited into the Over Dimensional Load Police |
13 |
| Escort Fund, a special fund that is created in the State |
14 |
| treasury. Subject to appropriation, the money in the Over |
15 |
| Dimensional Load Police Escort Fund shall be used by the |
16 |
| Department for its expenses in providing police escorts and |
17 |
| commercial vehicle enforcement activities. |
18 |
| Section 10. The State Finance Act is amended by changing |
19 |
| Section 5.708 as follows: |

| Section 15. The Illinois Vehicle Code is amended by |

| changing Section 15-302 and 15-312 as follows:

| Sec. 15-302. Fees for special permits. The Department with |
5 |
| respect to
highways under its jurisdiction shall collect a fee |
6 |
| from the applicant for
the issuance of a permit to operate or |
7 |
| move a vehicle or combination of
vehicles or load as authorized |
8 |
| in Section 15-301. The charge for each
permit shall consist of:
|
9 |
| 1. a service charge for special handling of a permit |
10 |
| when requested by an
applicant;
|
11 |
| 2. fees for any dimension, axle weight or gross weight |
12 |
| in excess of the
maximum size or weight specified in this |
13 |
| Chapter; and
|
14 |
| 3. additional fees for special investigations as in |
15 |
| Section 15-311 and
special police escort as in Section |
16 |
| 15-312 when required.
|
17 |
| With respect to overweight fees, the charge
shall be |
18 |
| sufficient to compensate in part for the cost
of the extra wear |
19 |
| and tear on the mileage of highways over which the
load is to |
20 |
| be moved. With respect to over-dimension permits, the fee
shall |
21 |
| be sufficient to compensate in part for the special privilege |
22 |
| of
transporting oversize vehicle or vehicle combination and |
23 |
| load and to
compensate in part for the economic loss of |
24 |
| operators of vehicles in
regular operation due to inconvenience |

| occasioned by the oversize movements.
|

| Fees to be paid by the applicant are to be at the rates |
3 |
| specified in this
Chapter. In determining the fees in Section |
4 |
| 15-306 and
paragraph (f) of Section 15-307, all weights shall |
5 |
| be
to the next highest 1,000 pounds and all distances shall be |
6 |
| determined from
the Illinois Official Highway Map.
|
7 |
| For repeated moves of like objects which cannot be |
8 |
| dismantled or disassembled
and which are monolithically |
9 |
| structured for permanent use in the transported
form, the fees |
10 |
| specified in Sections 15-305, 15-306 and 15-307 for other
than |
11 |
| the first move shall be reduced by $4 provided the objects are |
12 |
| to be
moved from the same origin to the same destination, the |
13 |
| number of trips
will not be less than 5, the trips will be |
14 |
| completed within 30 days, and
all applications are submitted at |
15 |
| one time. Round trip permits shall be
the same as a single trip |
16 |
| permit except the fee shall be computed
based upon the total |
17 |
| distance traveled, and shall be for the same vehicle,
vehicle |
18 |
| combination or like load traveling both directions over the |
19 |
| same
route, provided a description including make and model of |
20 |
| the equipment
being transported is furnished to the Department, |
21 |
| except that a vehicle
combination registered by the Department |
22 |
| as provided in Section 15-319 may
be one of the same class. |
23 |
| Limited continuous operation permits are to be
valid for a |
24 |
| period of 90 days or one year, and shall be for the same
|
25 |
| vehicle, vehicle
combination or like load.

| Sec. 15-312. Fees for Police Escort. When State Police |
3 |
| escorts are required by the Department for the
safety of the |
4 |
| motoring public, the following fees shall be paid by the
|
5 |
| applicant to the Illinois State Police Department : $100 $40 per |
6 |
| hour per State Police vehicle vehicle based upon actual
|
7 |
| pre-estimated time of the movement with a minimum fee of $300 |
8 |
| per State Police vehicle to be agreed upon
between Department |
9 |
| and applicant. Minimum fee $80 per vehicle . The Department |
10 |
| shall remit the moneys to the State Treasurer, who shall |
11 |
| deposit the moneys into the Over Dimensional Load Police Escort |
12 |
| Fund.
|
13 |
| The actual time of the movement shall be the time the |
14 |
| police escort is required to pick up the movement to the time |
15 |
| the movement is completed with a minimum time of 3 hours. Any |
16 |
| delays or breakdowns shall be considered part of the movement |
17 |
| time. Any fraction of an hour shall be rounded up to the next |

| Section 99. Effective date. This Act takes effect January |
21 |
| 1, 2009.
