| AMENDMENT NO. ______. Amend House Bill 4903 by replacing |

| everything after the enacting clause with the following:
|

| "Section 1. Short title. This Act may be cited as the |
5 |
| Transparency in College Textbook Publishing Practices Act. |
6 |
| Section 5. Definitions. In this Act: |
7 |
| "Alternative formats" means other versions of a specific |
8 |
| textbook, including paperbacks. |
9 |
| "Bundled textbook" means a textbook that is packaged with
|
10 |
| additional materials, including, but not necessarily limited |
11 |
| to, a
supplemental workbook CD-ROM, or online resource |
12 |
| password. |
13 |
| "Institution" means an institution of higher learning in |
14 |
| this State. |
15 |
| "Supplemental items" means supplemental items, not |
16 |
| including the textbook, that are developed by a third party and |

| that, by third-party contractual agreement, may not be offered |
2 |
| by a publisher separately from the textbook with which the |
3 |
| items are combined. |

| "Textbook" means a book that is intended for use as a |
5 |
| source
of study material for a class or group of students, a |
6 |
| copy of which
is expected to be available for the individual |
7 |
| use of each student
in that class or group. |
8 |
| "Unbundled textbook" means a textbook that is offered for
|
9 |
| sale without any additional materials.
|
10 |
| Section 10. Disclosure of information. When contacting or |
11 |
| being contacted by prospective clients, each publisher of |
12 |
| college textbooks shall disclose, in whatever form the |
13 |
| publisher is selling, all of the following to the faculty |
14 |
| member or, if applicable, the other entity in charge of |
15 |
| selecting textbooks for courses taught at an institution: |
16 |
| (1) The price at which the publisher would make the |
17 |
| textbook or supplemental materials available to the |
18 |
| bookstore on the campus of or otherwise associated with the |
19 |
| institution. |
20 |
| (2) The revision history for the textbook or |
21 |
| supplemental materials, including copyright dates and |
22 |
| substantial changes from past editions for the previous 10 |
23 |
| years, if any. |
24 |
| (3) The existence and price of alternative formats of |
25 |
| the textbook or supplemental materials.

| Section 15. Bundled textbooks. Publishers of college |
2 |
| textbooks are required to offer all bundled textbooks for sale |
3 |
| as individual unbundled textbooks and supplemental items. |
4 |
| Supplemental items in integrated textbooks are exempt. Nothing |
5 |
| in this Section shall be construed to require the bookstore on |
6 |
| the campus of or otherwise associated with an institution to |
7 |
| double stock or purchase textbooks and supplemental items as |
8 |
| both bundled and unbundled items. |
9 |
| Section 20. Institutional autonomy and academic freedom. |
10 |
| Nothing in this Act shall be construed to supersede |
11 |
| institutional autonomy or the academic freedom of persons |
12 |
| involved in the selection of textbooks and supplemental |
13 |
| materials. |
14 |
| Section 80. Enforcement. The Attorney General, a State's |
15 |
| Attorney, or any affected resident of this State may bring a |
16 |
| civil action to enforce this Act.".
