1 | AN ACT concerning insurance.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Covering ALL KIDS Health Insurance Act is | ||||||
5 | amended by changing Section 30 as follows: | ||||||
6 | (215 ILCS 170/30) | ||||||
7 | (Section scheduled to be repealed on July 1, 2011)

8 | Sec. 30. Program outreach and marketing. The Department may | ||||||
9 | provide grants to application agents and other community-based | ||||||
10 | organizations to educate the public about the availability of | ||||||
11 | the Program. The Department shall adopt rules regarding | ||||||
12 | performance standards and outcomes measures expected of | ||||||
13 | organizations that are awarded grants under this Section, | ||||||
14 | including penalties for nonperformance of contract standards. | ||||||
15 | The Department shall permit day and temporary labor service | ||||||
16 | agencies, as defined in the Day and Temporary Labor Services | ||||||
17 | Act and doing business in Illinois, to enroll as unpaid | ||||||
18 | application agents. | ||||||
19 | Notwithstanding any other rulemaking authority that may | ||||||
20 | exist, neither the Governor nor any agency or agency head under | ||||||
21 | the jurisdiction of the Governor has any authority to make or | ||||||
22 | promulgate rules to implement or enforce the provisions of this | ||||||
23 | amendatory Act of the 95th General Assembly. If, however, the |

1 | Governor believes that rules are necessary to implement or | ||||||
2 | enforce the provisions of this amendatory Act of the 95th | ||||||
3 | General Assembly, the Governor may suggest rules to the General | ||||||
4 | Assembly by filing them with the Clerk of the House and the | ||||||
5 | Secretary of the Senate and by requesting that the General | ||||||
6 | Assembly authorize such rulemaking by law, enact those | ||||||
7 | suggested rules into law, or take any other appropriate action | ||||||
8 | in the General Assembly's discretion. Nothing contained in this | ||||||
9 | amendatory Act of the 95th General Assembly shall be | ||||||
10 | interpreted to grant rulemaking authority under any other | ||||||
11 | Illinois statute where such authority is not otherwise | ||||||
12 | explicitly given. For the purposes of this amendatory Act of | ||||||
13 | the 95th General Assembly, "rules" is given the meaning | ||||||
14 | contained in Section 1-70 of the Illinois Administrative | ||||||
15 | Procedure Act, and "agency" and "agency head" are given the | ||||||
16 | meanings contained in Sections 1-20 and 1-25 of the Illinois | ||||||
17 | Administrative Procedure Act to the extent that such | ||||||
18 | definitions apply to agencies or agency heads under the | ||||||
19 | jurisdiction of the Governor.

21 | Section 99. Effective date. This Act takes effect January | ||||||
22 | 1, 2009.
